HOUSING AND REDEVELOPMENT COMMISSION RESOLUTION NO. 285
A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA TO APPROVE AN AMENDMENT TO HOUSING AND REDEVELOPMENT COMMISSION RESOLUTION NO. 238 TO MODIFY CONDITION NUMBER 9 AS RELATED TO
CONSTRUCTION OF PARKING AND A THIRD ACCESS FOR
THE VILLAGE COMMUTER RAIL STATION
WHEREAS, the Housing and Redevelopment Commission, at their meeting on
November 2, 1993, approved the design and site plans for the Carlsbad Village Commuter Rail
StatiodTransit Station subject to the findings and conditions contained in Housing and
Redevelopment Commission Resolution No. 238; and
WHEREAS, North County Transit District has requested a modification to one of
the conditions of approval whch requires concurrent construction of a thrd access to the expanded
parking lot for the Village Commuter RaiVTransit Station.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Housing and
Redevelopment Commission of the City of Carlsbad, California, as follows:
That the above recitations are true and correct.
That the Housing and Redevelopment Commission hereby APPROVES a modification to
Condition No. 9 of Housing and Redevelopment Commission Resolution No. 238, dated
November 2, 1993, to read as follows:

“NCTD shall be responsible for acquiring the property necessary and completing the required improvements, as set forth by the City Engineer, to construct an additional public street
access for the expansion of the parking lot at the Village Commuter RaiVTransit Station. NCTD shall enter into a standard “Development Improvement Agreement” with the City of Carlsbad, to be approved and executed by the Community Development Director, and provide security satisfactory to the City’s Finance Director to ensure construction of the third (adhtional) access within twelve
(12) months of the initiation of construction for the expanded parking lot, unless an extension of
time is granted by the Housing and Redevelopment Commission. The location for the third access shall be approved by the City of Carlsbad’s City Engineer. All plans, specifications and supporting
documents for all improvements and landscaping, as related to the third access, shall be prepared by NCTD to the satisfaction of the City Engineer. The plans shall be prepared on standard City plan
sheets and be processed through the normal City plancheck process and the work shall be inspected by City forces. “
PASSED, APPROVED, AND ADOPTED at a regular meeting of the Housing
and Redevelopment Commission of the City of Carlsbad, California, held on the 4th day of
