HomeMy WebLinkAbout1957-10-16; Municipal Water District; Resolution 65RESOLUTION NO. 65 mSOLUTION OF THE ROflRD OF DINCTORS OF CARLSBAD MUNICIPAL WATER DISTRICT DETERMINING THE NECESSITY TO INCUR BONDED INDEEYlXDNESS, TO BX PAYABLE FROM TAXES AND FORMING AN IMPROVEMENT DISTRICT TO BE KNOWN AS II~PROVEMENT DISTRICT NO. 2 OF C!.RLSBAD MLTNICIPAL WATER DISTRICT. LEVIED UPON LESS rrmm ALL OF THE DISTRICT WHEREAS, on July 31, 1957, this Board of Mrectors adopted Resolution No. 61 declaring the necessity for incurring a bonded indebtedness to be payable from taxes levied upon less than =all of the district and fixing time and place of hearing and giving notice of hearing; and WHEHEAS, in said resolution this Board fixed September 4, 1957 at the hour of 7:30 o'clock P.M., on said day, as the time, and the meeting place of the Board of Directors of Carlsbad Municipal Water District at the Carlsbad City Hall, 2%0 Pi0 Pic0 Drive, Carlsbad, California, as the place for a hearing by the Board of Directors of said district on the question of the formation of said proposed improvement district, the extent thereof, the proposed improvement and the amount of debt to be incurred. and place any person interested, including all persons owning property in the district or in the proposed improvement district would be heard; and Said resolution stated that at said time WHEREAS, at said time and place said hearing was had before this Board, and was adjourned f'rom time to time, and all persons desiring to be heard on said before the Board were heard and a full and fair hearing was had; and questions WHEREAS, at said hearing it appeared that there should be a change in the bound- aries of said proposed improvement district, and on September 16, 1957, this Board adopted its resolution declaring its intention to change the boundaries of said proposed improvement district and fixing time and place of hearing on such a change; and I WHEEAS, in said resolution this Board fixed October 2, 1957, at the hour of 7:30 o'clock P.M., on said day as the time and the meeting place of the Board of Directors of Carlsbad Municipal Water District at the Carlsbad City Hall, 2960 Pi0 Pic0 Boulevard, Carlsbad, California, as the place for a hearing by the Board of Directors of said district on such boundary change; and WHEREAS, at said time and place said hearing was had before this board and was adjourned from time to time and all persons desiring to be heard on said questions before the Board were heard and a full and fair hearing was had; and WHEREAS, at each of said hearings evidence was presented to the Board on said questions before it, and this Board is filly advised in the premises; NOW, THEREFORE, the Board of Directors of Carlsbad Municipal Water District does hereby RESOLVE, DETERMINE AND ORDER as follows: Section 1. "hat it is deemed necessary to incur the proposed bonded indebtness in the amount of $900,00 for the purpose of I- 'I the acquisition and construction of water transmission pipe lines with appurtenances and appurtenant works from the existing facilities of the Carlsbad Municipal. Water District located along thg El Cdno Real Road to points within theicarlsbad Municipal Water District covering generally the most southerly 18,000 feet of the Carlsbad Municipal Water District, including works, machinery and other property (including lands and easements) useful and necessary to store, convey, supply and otherwise make use of water for the lands and inhabitants within a portion of said Carlsbad Municipal Water District, and including proceedings for the authorization, issuance and sale of the bonds. expenses of all Section 2. boundaries of the portion of the district which will be benefited by the accomplish- ment of the above purpose are set forth on a map on file with the Secretary of the district, which map shall. govern for all details as to the extent of the improvement district, and that said portion of the district set forth on said rnap shall hereupon constitute and be known as I~PROVEMENT DISTRICT NO. 2 OF CARLSBAD MUNICIPAL WATER That as a result of said hearing and upon the evidence pre- sented, this Board does hereby determine that the exterior - 1 - DISTRICT.
