RESOLUTION NO. 112
JTION OF THE BOARD OF DIRECTORS OF CAR SBAD IUNICIPA WATER DISTRICT ESTABLISHING AND FIXING RATES AND CHARGES FOR
WATER SOLD, DISTRIBUTED AND DELIVERED BY THE CARLSBAD
MUNICIPAL WATER DISTRICT WITHIN CARLSBAD MUNICIPAL WATER
DISTRICT AND CANCELLING RESOLUTIONS NO. 88 and 89 OF SAID DISTRICT
WHEREAS, Ordinance No. 12 of Carlsbad Municipal Water District
amended Section 6 of Ordinance No. 10 of said District to provide that the rates
at which water will be sold by the District shall be fixed by resolution of the
Board of Directors of the District; and
WHEREAS, Section 22 of Municipal Water District Act of 1911, as
amended provides that the Board of Directors, so far as practicable, shall fix
such rate or rates for water in the district and in each improvement district
therein as will result in revenues which will pay the operating expenses of the
district, and the improvement district, provide for repairs and depreciation of
works, provide a reasonable suprlus for improvements, extensions, and en-
largements, pay the interest on any bonded debt and provide a sinking or other
fund for the payment of the principal of such debt as it may become due; and
WHEREAS, Section 22 of Municipal Water District Act of 1911, as
amended, further provides that the rates far water in each improvement district
may vary from the rates of the district and from other improvement districts
therein; and
WmREAS, the Board of Directors of Carlsbad Municipal Water District
have determined that in order fer the district to secure sufficient revenues to
pay the operating expenses of said district and improvement districts therein
and to provide for other items set forth in said Section 22 of Municipal Water
District Act of 1911, it is necessary to change the rates and charges for all
water sold, distributed and delivered by the District within said district.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTOR;
OF CARLSBAD MUNICIPAL WATER DISTRICT AS FOLLO'WS:
1. Resolutions No. 88 and 89 of the Board of Directors of Carlsbad
Municipal Water District establishing and fixing rates and charges for all water

sold, distributed and delivered by the Carlsbad Municipal Water District within
said District, adopted by the Board of Directors on October 14, 1958, is herebj
rescinded.
2. The rates and charges for water sold, distributed and delivered by
the District within said District and improvement districts therein shall be as
he reinafter set forth.
WHOLESALE RATE
a. The rate per acre foot shall be the average cost of the water to the District for the preceding month, plus $14. 00.
b. Each wholesale consumer agency shall be entitled to one meter connection without the payment of any standby charge. For each additional meter connection, the wholesale consumer agency shall pay a monthly standby
charge of $10.00.
RETAIL RATE
1. For consumers who are able to take water at a minimum
rate flow equal to 5070 of the average rate of flow during
the maximum two hour period:
Standby charge (up to 1" meter) - individual Standby charge (above 1'' meter) - individual $3.00 $5.00
First 1, 000 cubic feet or fraction thereof
Next 2, 000 cubic feet or fraction thereof
Over 3, 000 cubic feet
$. 25 per 100 cu. ft. $. 18 per 100 cu.ft.
$. 11 per 100 cu. ft.
Minimum charge per meter installation per month - $1 1, 10
2. For consumers who are not able to take water at a
minimum rate flow equal to 50% of the average rate
of flow during the maximum two hour period:

a. shall prevail for multiple unit rental properties, trailer courts, motels or any similar arrangement of units shall be as follows:

(1) If there are 10 living units or less, the monthly standby charge shall be equal to the monthly standby
charge for an individual retail connection multiplied
by 5070 of the living units.

monthly standby charge be less than five times the monthly standby charge for an individual retail con- nection.
The applicant for a retail connection shall pay the entire cost of the connection. Before the service connection is
made, the applicant must pay a deposit equal to the estimated cost of the service connection, as determined by the district, plus 10%. In the event that the actual cost of said service connection is less than the deposit the applicant shall receive a refund of the unused portion of
the deposit. In the event the actual cost of the service
connection is more than the deposit the applicant shall
immediately pay the remaining amount due upon receipt of
a bill from the district.
4. Upon termination of any temporary retail service, temporary meters will be removed by the dirrrbrict, at the request of the
customer. Any cost incurred by the district in the removal
of such meters shall be paid by the customer.
5. If temporary service is changed to a permanent status the
service meter shall become the property of the district and will be operated and maintained by the district.
6. The determination of the District as to whether a consumer is able to take water at a minimum rate flow equal to 50% of the average rate of €low during the maximum two hour period shall be final and conclusive on all parties.
