HomeMy WebLinkAbout1960-06-21; Municipal Water District; Resolution 113RESOLUTION NO, 11 3 RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAR MUNICIPAL WATER DISTRICT DE- TERMINING THE NECESSITY TO INCUR BONDED INDEBTEDNESS, TO BE PAYABLE FROM TAXES LEVIED UPON LESS THAN ALL OF THE DISTRICT, AND FORMING AN IMPROVENLENT DISTRICT WITH- IN THE BOUNDARIES OF SAID DISTRICT TO BE KNOWN AS IMPROVEMENT DISTRICT NO. 3 OF CARLSBAD MUNICIPAL WATER DISTRICT .. .. WHEREAS, on March 15, 1960, this Board of Directors adopted Resolution No. 108 declaring the necessity for incurring a bonded in- debtedness to be payable from taxes levied upon less than all of the district and fixing time and place of hearing and giving notice of hearing; and WHEREAS, in said resolution this Board fixed April 19, 1960, at the hour of 2:OO o'clock P. M., on said day, as the time, and the meet- ing place of the Board of Directors of Carlsbad Municipal Water District at 2698 State Street, Carlsbad, California, as the place for a hearing by the Board of Directors of said district on the questions of the formation of said proposed improvement district, the extent thereof, the proposed improvement and the amount of debt to be incurred. Said resolution stated that at said time and place any person interested, including all persons owning property in the district or in the proposed improvement district would be heard; and WHEREAS, at said time and place said hearing was had before this Board, and was adjourned from time to time, and all persons desiring to be heard on said questions before the Board were heard and a full and fair hearing was had; and WHEREAS, at said hearing it appeared that there should be a change in the boundaries of said proposed improvement district, and on May 17, 1960, this Board adopted its resolution declaring its intention _. ... . . . . . . . .~ . . . .- . - .. to change the boundaries of said proposed improvement district and i I b . to change the amount of the proposed debt to be incurred by said pro- posed improvement district for which bonds are to be issued therefor and fixing time and place of hearing on such change; and WHEREAS, in said resolution this Board fixed June 21, 1960, at the hour of 2:OO o'clock P. M., on said day as the time and the meet- ing place of the Board of Directors of Carlsbad Municipal Water District at 2698 State Street, Carlsbad, California, as the place for a hearing by the Board of Directors of said District on such changes, and WHEREAS, at said time and place said hearing was had before the Board and all persons desiring to be heard on said questions before the Board were heard and a full and fair hearing was had; and WHEREAS, at each of said hearings evidence was presented to the Board on said questions before it, and this Board is fully advised in the premises; NOW, THEREFORE, the Board of Directors of Carlsbad Municipal Water District does hereby RESOLVE, DETERMINE AND ORDER as follows: Section 1. That it is deemed necessary to incur the proposed bonded indebtedness in the amount of $1000, 000 for the purpose of the acquisition and construction of a waterworks system, including conduits, pipeline s, re s e rvoir s, works , machine ry and other property useful and necessary to store, convey, supply or otherwise make use of water for the land and inhabitants within a portion of said Carlsbad Municipal Water District, and including expense of all proceedings for the authorization, issuance and sale of the bonds. Section 2. That as a result of said hearing and upon the evidence presented, this Board does hereby determine that the exterior boundaries of the portion of the district which will be benefited by the accomplishment of the above purpose are set forth on a map on file with the Secretary of the district, which map shall govern for all details as to the extent of the -2 - improvement district, and that said portion of the district set forth on said map shall hereupon constitute and be known as IMPROVEMENT DISTRICT NO. 3 OF CARLSBAII MUNICIPAL WATER DISTRICT, ADOPTED, SICICEXI AND APPROVED this 21st day of June, 1960.
