RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT ORDERING, CALLING, PROVIDING FOR, AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN IMPROVEMENT DISTRICT NO, 3 OF SAID DISTRICT ON DEXXMBER 20 , 1960 , FOR THE PURPOSE OF SUBMITTING TO THE QUALI- FIED VOTERS OF SAID IMPROVEMENT DISTRICT A PROPOSITION OF INCURRING BONDED INDEBTED- NESS AND ISSUING BONDS OF SAID DISTRICT FOR SAID IMPROVEMENT DISTRICT. The Board of Directors of Carlsbad Municipal Water District DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That this Board deem6 it necessary that the Carlsbad Municipal Water District incur a bonded indebtedness by the issuance of bonds of the district for Improvement District No. 3 thereof in the amount; of one million dollars ($1,000,000) for the purpose of the acquisition and construction of a waterworks system, including conduits, pipelines, reservoirs, works, machinery and other property useful and necessary to store, convey, supply or otherwise make use of water for the land and inhabitants within the exterior boundaries of said Improvement District No. 3, and including expense of all pro- ceedings for the authorization, issuance and sale of the bonds. That, following a hearins thereon as by law provided, this Board has determined, and does hereby determine and state, that the portion of said district which will be benefited by the accomplishment of said purpose hereinabove stated and by incurring said bonded indebtedness constitutes and is known as Improvement District No. 3 and that a map showing the exterior boundaries of said improve- ment dlatrict is on file with the Secretary of said district, which map shall govern for all details as to the extent of the improvement district. Section 3. That the maximum term which the bonds proposed to be issued, or any portion or series thereof, shall run before maturity shall not exceed the maximum term per- mitted by law, to wit,, forty (40) years from the date of said bonds OP each series thereof, but said bonds may be made to mature within a lesaer number of years; that the maximum rate of intersst to be paid thereon shall not exceed the maxi- mum rate permitted by law, to wit, five per cent (55) per annum, payable semiannually, except that interest for the first year shall be payable at the end of said year, the actual rate or rates to be determined at the time of the sale or sales thereof, Section 4. That a special election be held, and the same is hereby called to be held, in said Improvement District No. 3 of Carlsbad Municipal Water District 2. Munic.W.D.(lgll) 1mpr.D. Resn. Elec 'n on the 20th day of December , 19 60, for the purpose of submitting to the quallfied voters of said improvement dis- trict the proposition of incurring the said indebtedness and issuing bond8 of said district for said improvement district, in the amount hereinabove set forth, and for the purpose hereinabove stated. That if the proposition for the incurring of said indebtedness so submitted receives the requisite number of votes, to wit, more than two-thirds of the votes of the quali- fied voters voting at such election, bonds of said district for said improvement district in not exceeding the principal amount hereinabove stated shall be issued and sold for the purpose hereinabove set forth, Said bonds will be bonds of the district, but taxes for the payment of such bonds and the interest thereon shall be levfed exclusively upon the taxable property within said Improvement District No. 3 of Carlsbad Municipal Water District all as provided in the Municipal Water District Act of 1911, as amended. Section 5. That the polls for said election shall be opened at seven o'clock A.M, of the day of said election and shall remain open continuously from said time until seven o'clock P.M. of the same day, when said polls shall be closed, exoept as provided in Section 5734 of the Elections Code of the State of California. Section 6. That on the ballots to be used at said election, in addition to any other matters required by law, there shall be printed substantially the following: 3. All marks except the cross (+) are,forbidden, All dis- tinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear, or deface this ballot, return it to the inspector of election and obtain another . Elec'n Section 7, A moss (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoptlon of the question or propo- sition. A cross (+) placed in the voting square after the word ''NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. Section 8. That in all particulars not recited in this resolution, said election shall be held and con- ducted in accordance with the provisions of the Elections Code of the State of California so far as the same shall be applicable, except as otherwise provided in the Municipal Water District Act of 1911, as amended. Section 10. That the Secretary of this Board shall cause this resolution to be published once a week for two (2) successive weeks prior to the date of the election in CARLSBAD JQURNAL a newspaper of general circulation printed and published in the diljtrict. Said resolution shall also be posted in three (3) public places within said Improvement District No. 3 not less than two (2) weeks prior to the date of the election.
