RESOLUTION NO. 179
A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT ESTABLISHING
AND FIXING RATES AND CHARGES FOR WATER SOLD, DISTRIBUTED AND DELIVERED BY THE CARLSBAD
MUNICIPAL WATER DISTRICT AND RESCINDING RESOLUTION NO. 119 AND 131 OF SAID DISTRICT.
WHEREAS, Ordinance No. 12 of Carlsbad Municipal Water District amended
Section 6 of Ordinance No. 10 of said District to provide that the rates at which
water will be sold by the District shall be fixed by Resolution of the Board of
Directors of the District; and

WHEREAS, Section 22 of Municipal Water District Act of 1911, as amended,
provides that the Board of Directors, so far as practicable, shall fix such rate or
rates for water in the District and in each improvement District therein, as will
result in revenues which will pay the operating expenses of the District, and the
Improvement District, provide for repairs, and depreciation of works, provide a
reasonable su.pplus for,improvements, extensions, and enlargements, pay the interest
on any bonded debt and provide a sinking or other fund for the payment of the
principal of such debt as it may become due; and
WHEREAS, Section 22 of Municipal Water District Act of 1911, as amended,
further provides that the rates for water in such improvement District may vary from
the rates of the District and from other Improvement Districts therein; and -
WHEREAS, the Board of Directors of Carlsbad Municipal Water District have
determined that -it is to the best interests of the District and to the inhabitants
thereof to change the rates and charges for all water sold, distributed and delivered
by the District within said District.
NQW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT AS FOLLOWS:
a. Resolution No. 119 and Resolution No. 131 of the Board of Directors of
Carlsbad Mun%cipal Water District, establishing and fixing rates and charges for all
water sold, distributed and delivered by the Carlsbad Municipal Water District within
said District, adopted by the Board of Directors on September 20, 1960 and February
21, 1961, respectively, are hereby rescinded.
- b. The rates and charges for Mater sold, distributed and delivered by the
District within said District and Improvement Districts therein shall be as hereinafter
set forth:

a. For water sold in Improvement District No. 1 outside of the
boundaries of Improvement District Nos. 2 and 3, the rate shall
be the average cost of the water to the District for the preceding
month, plus $10.00 per acre foot, except that where water is sold
(or sold for resale therein) which has been transported through
wafer lines constructed by Improvement District No. 2 or Improyement
District No. 3, the rate per acre foot shall be the average cost of
the water to the District for the preceding month, plus $10.00 per
acre foot, plus $1.00 per acre foot per mile of said ID 2's or ID 3's
pipelines used to transport said water.
b. For water sold in Improvement District Nos. 2 and 3, the rates shall
be the average cost of the water to the Pistrict for the preceding
month, plus $25.00 per acre foot.
RETAIL RATE
a. For all retail consumers, the following rates apply:
First 1,000 cubic feet, or fraction thereof, 0.30 dollars per
hundred cubic feet; next 2,000 cubic feet or fraction thereof,
0.21 dollars per 100 cubic feet; over 3,000 cubic feet, 0.125
dollars per 100 cubic feet.
b. Standby charges per month are as follows:
Up to one inch meter - individual, $3.00;
Above one inch meter - individual, $5.00
For multiple units (multiple unit rental properties, trailer
courts, motels or any similar arrangement of units)
shall be as follows:
(1) If there are ten living units or less, the monthly
standby charge shall be equal to the monthly standby
charge for an individual retail connection multiplied
by 50% of the living units.
(2) If there are more than ten living units, the monthly
standby charge shall be equal to the monthly standby
charge for an individual retail connection multiplied
by 40% of the living units; but in no case shall said
monthly standby charge be less than five times the
monthly standby charge for an individual retail connection.
c. The applicant for a retail connection shall pay the entire cost of the
connection. Before the service connection is made, the applicant must
pay a deposit equal to the estimated cost of the service of connection,
as determined by the District, plus 10%. In the event that the actual
cost of said service connection is less than the deposit, the applicant
shall receive a refund of the unused portion of the deposit.

e. If temporary serxice is changed to a permanent status, the service
meter shall become the property of the District, and will be operated and maintained by the District.
