HomeMy WebLinkAbout1969-08-20; Municipal Water District; Resolution 244RESOLUTION NO. 244 c RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT MAKING APPLICATION FOR THE DETACHMENT OF TERRITORY FROM SAID DISTRICT AND SEEKING THE APPROVAL OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN DIEGO. WHEREAS, the Board of Directors of the Carlsbad Municipal Water District desires to initiate proceedings for the detachment from said District of the territory hereinafter described. NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1: Application and a proposal is hereby made to the Local Agency Formation Commission of the County of San Diego for a change of organization as follows: A. This proposal is made pursuant to the District Reorganization Act of 1965 commencing with Section 56000 of the Government Code of the State of California. B. The nature of the proposed change of organization and the names of all districts for which any such change of organization is proposed is as follows: 1. The detachment of the hereinafter described territory from the Carlsbad Municipal Water District. C. The names of all other affected counties, cities and districts are: 1. The County of San Diego 2. The San Diego County Water Authority 3. The Metropolitan Water Authority D. The territory proposed to be detached from the Carlsbad Municipal Water District is uninhabited. A description -1- of the exterior boundaries of said territory is set forth in Exhibit "A" attached hereto and made a part hereof. It is desired that the proposed detachment provide for and be made subject to the following terms and conditions: 1. The payment of all costs of said detachment, including but not limited to, advertising, engineering, and attorney's fees. E. The reasons for this proposal are as follows: 1. The territory can better be served with water by the Olivenhain Municipal Water District. Section 2: The Secretary of said District is hereby authorized and directed to file a certified copy of this Resolution with the Executive Officer of the Local Agency Formation Commission of the County of San Diego, State of California, and the Secretary of the District is hereby authorized and directed to provide to the Local Agency Formation Commission of the County of San Diego r- 1 such information and/or maps as may be required by the Formation Commission.
