HomeMy WebLinkAbout1972-01-05; Municipal Water District; Resolution 271RESOLUTION NO. 271 RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DIS- TRICT MAKING APPLICATION FOR THE AN- NEXATION OF TERRITORY TO SAID DIS- TRICT AND SEEKING THE APPROVAL OF THE LOCAL AGENCY FORMATION COMMIS- SION OF THE COUNTY OF SAN DIEGO. (TENAGLIA ANNEXATION) WHEREAS, the Board of Directors of the Carls- bad Municipal Water District desires to initiate pro- ceedings for the annexation to said District of the territory hereinafter described. NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1: Application and a proposal is here- by made to the Local Agency Formation Commission of the County of San Diego for a change of organization as follows: A. This proposal is made pursuant to the District Reorganization Act of 1965 commencing with Section 56000 of the Government Code of the State of California. B. The nature of the proposed change of or- ganization and the names of all districts for which any such change of organization is proposed is as follows: 1. The annexation of the herein- _- after described territory to the Carlsbad Municipal Water District. C. The names of all other affected counties, cities and districts are: 1. The County of San Diego. 2. The San Diego County Water Authority. 3. The Metropolitan Water District. 4. The City of Oceanside. D. The territory proposed to be annexed to the Carlsbad Municipal Water District is uninhabited. A de- scription of the exterior boundaries of said territory is set forth in Exhibit "A" attached hereto and made a part hereof. It is desired that the proposed annexation pro- vide for and be made subject to the following terms and conditions: 1. The inclusion in Improvement Dis- trict No. 1 and No. 4 of the Carls- bad Municipal Water District. 2. The payment of all costs of said annexation, including, but not limited to, advertising, engineer- ing, and attorneys' fees. E. The reasons for this proposal are as follows: 1. The Carlsbad Municipal Water Dis- trict is empowered to and is en- gaged in the distribution and delivery of water and the Dis- trict owns and operates facil- ities with sufficient capacity to provide water service to the territory proposed to be annexed. Section 2: The Secretary of said District is hereby authorized and directed to file a certified copy of this Resolution with the Executive Officer of the Local Agency Formation Commission of the County of -2- _- San Diego, State of California, and the Secretary of the District is hereby authorized and directed to pro- vide to the Local Agency Formation Commission of the County of San Diego such information and/or maps as may be required by the Formation Commission.
