A RESOLUTION QF THE BOARD OF DIRECTORS OF CARLSBAD
MUNICIPAL WATER DISTRICT APPLYING FOR THE CONSENT OF THE SAN DIEGO COUNTY WATER AUTHORITY TO THE EX- CLUSION OF CERTAIN TERRITORY FROM CARLSBAD XUNICIPAL WATER DISTRICT PURSUANT TO SECTION 11 OF 'EHE COUNTY
WATER AUTHORITY ACT, WHICH TERRITORY IS NOW INCOR- PORATED WITH OLIVENHAIN MUNICIPAL WATER DISTRICT (LA COSTA VALE UNIT NO. 1 DETACHMENT)
WHEREAS, Carlsbad Municipal Water District and Oliven-
hain Municipal Water District are both member agencies of the San
Diego County Water Authority, and
WHEREAS, certain terrfkory lying with Carlsbad Municipal
Water District has heretofore been included within the corporate
area of Olivenhain Municipal Water District, and
WHEREAS, the Board of Directors of Carlsbad Municipal
Water District wishes to initiate proceedings for the exclusion of
said territory from Carlsbad Municipal Water District under the
provisions of Section 11 of the County Water Authority Act in order
that such exclusion from Carlsbad Municipal Water District will not

result in the exclusion of said territory from the San Diego County
Water Authority; and
WHEREAS, it appears to the Board of Directors of Carlsbad
Municipal Water District that said territory can better be served
with water by the Olivenhain Municipal Water District.
NOW, THEREFORE, the Board of Directors of Carlsbad Muni-
cipal Water District does hereby resolve and order as follows:
1. The Board of Directors of Carlsbad Municipal Water
District hereby applies to the Board of Directors of San Diego
County Water Authority for its consent to exclude said territory
from Carlsbad Municipal Water District, without its exclusion from
San Diego County Water Authority, and hereby requests that the terms
and conditions of such exclusion be fixed as follows:
(1) The payment by La Costa Land Company
of all costs of said detachment,
including, but not limited to, ad-
vertising, engineering, and attorney's
fees.
2. The boundaries of the territory proposed to be ex-
cluded from Carlsbad Municipal Water Distkict are set forth and
described in Exhibit "A", attached hereto and by this reference
incorporated heaein.
ADOPTED, SIGNED AND APPROVED this 2nd day of May, 1973.

DETACHMENT
All that portion of Section 36, Township 12 South, Range 4 West, San Bernardino Meridian in the County of San Diego,
State of California according to the Official Plat thereof described as follows:
Beginning at the point of intersection of the Easterly line
of said Section 36 with a line drawn parallel with and dis- tant 15.00 feet Southeasterly measured at right angles from
the center line of La Costa Avenue as shown on map of La Costa South Unit No. 5, Map No. 6600, filed in the Office of
the County Recorder of said County; thence along said Easterly line of Section 36
South Oo 09' 46" East 734.88 feet; thence
South Oo 10' 00" East 59.51 feet; thence leaving said Easterly line
North 21° 25' 35" West 740.32 feet to an intersection with the aforementioned parallel line; thence along said line
North 68O 34' 25" East 288.09 feet to the POINT OF BEGINNING.
Said parcel of land containing 2.448 acres.
