HomeMy WebLinkAbout1973-10-17; Municipal Water District; Resolution 310c RESOLUTION NO. 310 *,- I A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT APPLYING FOR THE CONSENT OF THE SAN DIEGO COUNTY WATER AUTHORITY TO THE EX- CLUSION OF CERTAIN TERRITORY FROM CARLSBAD MUNICIPAL WATER DISTRICT PURSUANT TO SECTION 11 OF THE COUNTY WATER AUTHORITY ACT, WHICH TERRITORY IS NOW INCOR- PORATED WITHIN THE CITY OF OCEANSIDE (GRANVILLE PARK DETACHMENT) WHEREAS, Carlsbad Municipal Water District and City of Oceanside are both member agencies of the San Diego County Water Authority; and WHEREAS, certain territory lying within Carlsbad Municipal Water District has heretofore been included within the corporate area of City of Oceanside; and WHEREAS, the Board of Directors of Carlsbad Municipal Water District wishes to initiate the proceedings for the ex- clusion of said territory from Carlsbad Municipal Water District under the provisions of Section 11 of the County Water Authority Act in order that such exclusion from Carlsbad Municipal Water District will not result in the exclusion of said territory from the San Diego County Water Authority; and WHEREAS, it appears to the Board of Directors of Carlsbad Municipal Water District that said territory can better be served with water by the City of Oceanside. NOW, THEREFORE, THE BOARD OF DIRECTORS OF CARLSBAD MUNI- CIPAL WATER DISTRICT DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: 1. The Board of Directors of Carlsbad Municipal Water District hereby applies to the Board of Directors of San Diego County Water Authority for its consent to exclude said terri- tory from Carlsbad Municipal Water District, without its ex- clusion from San Diego County Water Authority, and hereby -1- requests that the terms and conditions of such exclusion be fixed as follows: (a) The payment by City of Oceanside of all costs of said detachment, including, but not limited to, ad- vertising, engineering, and attor- ney's fees. 2. The boundaries of the territory proposed to be ex- cluded from Carlsbad Municipal Water District are set forth and described in Exhibit "A" attached hereto and by this re- ference incorporated herein. ADOPTED, SIGNED AND APPROVED this 17th day of October, 1973. ENGELMA", Assistant Secretary of the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT, DO HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT, at a regular meeting of said Board held on the 17th day of October, 1973, and that it was so adopted by the fol- lowing vote: AYES : Directors: KELLY, MacLEOD, MAERKLE and ENGELMANN NOES : Directors: None ABSENT : Directors : CARMICHAEL Assistant Secretary of CARLSBAD MUNICIPAL WATER DISTRICT and of the Board of Directors thereof. -3- ANNEXATION PARCEL TO CITY OF OCEANSIDE .- All that portion of Lot A as shown on Granville Park No. 2 Subdivision Map No. 2037, filed June 18, 1927 in the City of Carlsbad, County of San Diego, State of California, more particularly described as follows: Commencing at the Northeasterly corner of said Lot A, said point being also on the Southerly line of Lot 2 of Section 1, T12S, RSW, S.B.B.M.; thence North 89O53'45" West along the Northerly line of said Lot A and the Southerly line of said Lot 2 of Section 1, a distance of 365.82 feet to the Southeast corner of Lot 3 of said Section 1, said point be- ing a point in the boundary of the City of Oceanside; thence continuing North 89O53'45" West 495.51 feet along the Southerly line of said Lot 3, Section 1 and the Northerly line of said Lot 2, Granville Part to an intersection with the centerline of a 40 foot easement described in Book 69- 96, Page 102 of Deeds, said point being the TRUE POINT OF BEGINNING; thence retracing South 89"53'45" East along said Southerly line of Lot 3, Section 1 and said Northerly line of Lot A, Granville Park, a distance of 265.75 feet to an intersection with a nontangent 300 foot radius curve con- cave Northwesterly, a radial to which bears South 53O26'04" East; thence leaving said City limits line and said common line of Lots A and 3 Westerly along the arc of said curve through a central angle of 14°59'14" a distance of 80.12 feet; thence tangent to said curve South 51°33'10" West to the mean high tide line of the Pacific Ocean; thence North- erly along said mean high tide line to an intersection with the aforementioned Northerly line of Lot A of Granville Park and the Southerly line of Lot 3 of Section 1 and the City limits of the City of Oceanside; thence Easterly along said Northerly line of Lot A, Granville Park and Southerly line of Lot 3, Section 1 to the TRUE POINT OF BEGINNING.
