HomeMy WebLinkAbout1979-08-20; Municipal Water District; Resolution 390RESOLUTION NO. 390 RESOLUTION OF BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT DETERMINING THE AMOUNTS NECESSARY TO RE RAISED BY TAXATION IN THE CARLSBAD MUNICIPAL WATER DISTRICT, IMPROVEMENT DISTRICT NO. 1 OF THE CARLSBAD MUNICIPAL WATER DISTRICT, IMPROVEMENT DISTRICT NO. 2 OF THE CARLSBAD MUNICIPAL WATER DISTRICT, IMPROVEMENT DISTRICT NO. 3 OF THE CARLSBAD MUNICIPAL WATER DISTRICT, AND IMPROVEMENT DISTRICT NO. 4 OF THE CARLSBAD MUNICIPAL WATER DISTRICT, DURING THE FISCAL YEAR COMMENCING JULY 1, 1979, AND ENDING JUNE 30, 1980, AND FIXING THE RATES OF TAX TO BE LEVIED FOR SUCH FISCAL YEAR WHEREAS, Sections 72090 through 72099, inclusive, of the Water Code provide that the Board of Directors of Carlsbad Municipal Water District shall determine the amounts necessary to be raised by taxation during the fiscal year and that the Board of Directors shall fix the rate or rates of tax to be levied which will raise the amounts of money required by the District; and F 1. - WHEREAS, the Board of Directors of Carlsbad Municipal Water District is required to certify to the Board of Supervisors of the County of San Diego and the County Auditor of the County of San Diego the rate or rates so fixed and shall furnish a sta- tement in writing containing the following: (a) An estimate of the minimum amount of money required to be raised by taxation during the fiscal year for the payment of the principal of and interest on any bonded debt of the District or an Improvement f District therein that will become due before the proceeds of a tax levied at the next general tax levy will be available. (b) An estimate of the minimum amount of money -1- required to be raised by taxation during the fiscal year for all other purposes of the District; and WHEREAS, there have been duly formed within the bound- aries of the Carlsbad Municipal Water District four improvement districts known as Improvement District No. 1 of the Carlsbad Municipal Water District, Improvement District No. 2 of the Carlsbad Municipal Water District, Improvement District No. 3 of the Carlsbad Municipal Water District, and Improvement District No. 4 of the Carlsbad Municipal Water District; and WHEREAS, there now exists a bonded indebtedness against each of said Improvement Districts; and WHEREAS, in the judgment of the Board of Directors of Carlsbad Municipal Water District, the revenues of the District and the Improvement Districts therein will probably be inadequate to pay the principal and interest of the bonded debt of the said Improvement Districts and all other amounts set forth in Section 71616 of the Water Code. NOW, THEREFORE, THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS : 1. That the Board of Directors of Carlsbad Municipal Water District hereby determines that the estimated minimum amounts necessary to be raised by taxation during the fiscal year commencing July 1, 1979 and ending June 30, 1980 are as follows: (a) Carlsbad Municipal Water District: None for the payment of any principal and interest for bonded debt of said Water District. $155,067.00 for all other purposes of the District. -2- (b) Improvement District No. 1 of Carlsbad Municipal Water District: $ 84,850.00 and interest on the bonded debt of said Improvement District. for payment of principal None for all other purposes of the Dis trict. (c) Improvement District No. 2 of Carlsbad Municipal Water District: $ 65,237.00 for payment of principal and interest on the bonded debt of said Im- provement District. None for all other purposes of the Dis- trict. (d) Improvement District No. 3 of Carlsbad Municipal Water District: $ 49,002.00 for payment of principal and interest on the bonded debt of said Im- provement District. None for all other purposes of the Dis- trict. (e) Improvement District No. 4 of Carlsbad Municipal Water District: $ 54,350.00 for payment of principal and interest on the bonded debt of said Im- provement District. None for all other purposes of the Dis- trict. 2. That the Board of Directors of Carlsbad Municipal Water District hereby fixes the rates of taxes to be levied in the Carlsbad Municipal Water District as follows: (a) For Carlsbad Municipal Water District: $ .06 for each $100.00 of assessed valuation on all properties within the boundaries of Carlsbad Municipal Water District, as such assessed val- uation appears on the last equalized assessment roll of the County Assessor of the County of San Diego. (b) For Improvement District No. 1 of Carlsbad Municipal Water District: (1) $ .03 for each $100.00 of assessed valuation on all property within the boundaries of Improvement -3- District No, 1 of Carlsbad Municipal Water District as such assessed Val- uations appear on the last equalized assessment roll of the County Asses- sor of the County of San Diego, with such levy being made for bond retire- ment purposes. (2) No levy is required on property within the boundaries of Improvement District No. 1 of Carlsbad Municipal Water District for all other purposes of said Improvement District. (c) For Improvement District No. 2 of Carlsbad Municipal Water District: (1) $ .08 for each $100.00 of assessed valuation on all property within the boundaries of Improvement District No. 2 of Carlsbad Municipal Water District as such assessed Val- uations appear on the last equalized assessment roll of the County Asses- sor of the County of San Diego, with such levy being made for bond retire- ment purposes. (2) No levy is required on property within the boundaries of Improvement District No. 2 of Carlsbad Municipal Water District for all other purposes of said Improvement District. (d) For Improvement District No. 3 of Carlsbad Municipal Water District: (1) $ .20 for each $100.00 of assessed valuation on all properties within the boundaries of Improvement District No. 3 of Carlsbad Municipal Water District as such assessed Val- uations appear on the last equalized assessment roll of the County Asses- sor of the County of San Diego, with such levy being made for bond retire- ment purposes. (2) No levy is required on property within the boundaries of Improvement District No. 3 of Carlsbad Municipal Water District for all other purposes of said Improvement District. (e) For Improvement District No. 4 of Carlsbad Municipal Water District: (1) $ .02 for each $100.00 of assessed valuation on all properties within the boundaries of Improvement District No. 4 of Carlsbad Municipal Water District as such assessed Val- -4- uations appear on the last equalized assessment roll of the County Asses- sor of the County of San Diego, with such levy being made for bond retire- ment purposes. (2) No levy is required on property within the boundaries of Improvement District No. 4 of Carlsbad Municipal Water District for all other purposes of said Improvement District. 3. That the Board of Directors of Carlsbad Municipal Water District hereby directs that, at the time and in the manner required by law for the levying of taxes for county purposes, the Board of Supervisors of the County of San Diego shall levy, in addition to such other tax as may be levied by said Board of Supervisors, at the rates heretofore fixed and determined by the Board of Directors of Carlsbad Municipal Water District, taxes upon the property within the Carlsbad Municipal Water District, Improvement District No. 1 of Carlsbad Municipal Water District, Improvement District No. 2 of Carlsbad Municipal Water District, - Improvement District No. 3 of Carlsbad Municipal Water District, and Improvement District No. 4 of Carlsbad Municipal Water District, as hereinabove set forth. 4. Any tax levies shall be made in accordance with all applicable statutes in effect on the date of levying the tax rate by the Board of Supervisors. 5. That the Board of Directors of Carlsbad Municipal Water District hereby directs that any territory previously excluded from the Carlsbad Municipal Water District shall not be subject to taxation by Carlsbad Municipal Water District or the Improvement District applicable or Improvement-Districts of Carlsbad Municipal Water District. 6. That the Board of Directors of Carlsbad Municipal Water District hereby directs that this Resolution shall take effect immediately and shall be effective for purposes of taxa- -5- tion during the fiscal year commencing July 1, 1979 and ending June 30, 1980. 7. That the Secretary of the Carlsbad Municipal Water - District is hereby authorized and directed to forward three cer- tified copies of this Resolution to the Board of Supervisors of the County of San Diego.
