Home My WebLink About1979-09-05; Municipal Water District; Resolution 391RESOLUTION NO. 391 A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT ORDERING THE DETACHMENT OF CERTAIN TERRITORY DESIGNATED "LA COSTA NORTHEAST DETACHMENT" FROM THE CARLSBAD MUNICIPAL WATER DISTRICT PURSUANT TO SECTION 56322 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA (LA COSTA NORTHEAST DETACHMENT) THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT DOES HEREBY RESOLVE AND ORDER AS FOLLOWS: 1. The following facts are hereby found and determined to be true: (a) That proceedings for detachment were initiated by the owners of the property here- inafter described by petition directly to the SAN DIEGO LOCAL AGENCY FORMATION C0,WIS- SION, for detachment of said property from CARLSBAD MUNICIPAL WATER DISTRICT. (b) Such detachment was approved by the SAN DIEGO LOCAL AGENCY FORMATION COMMISSION by its Resolution DD 713-7, adopted August 7, 1978, wherein the SAN DIEGO LOCAL AGENCY FORMATION COMMISSION did approve such detach- ment and authorized the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT to detach such territory without notice and hearing by the Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT and without an election, in accordance with Government Code of the State of California, Section 56261. -1- c (c) The territory proposed to be de- tached is uninhabited. (d) The reasons for the proposed de- tachment are: 1. The land is currently within the boundaries of the BUENO COLORADO MUNICIPAL WATER DISTRICT and can be best served with waterworks admini- stered by BUENO COLORADO MUNICIPAL WATER DISTRICT. 2. The detachment of said land will be for the best interests of the CARLSBAD MUNICIPAL WATER DISTRICT 3. The detachment of said land will be for the best interests of the land and the owners thereof. 4. The owners of all of the land within the territory to be detached have consented to the proposed de- tachment in writing. 2. The Board of Directors of CARLSBAD MUNICIPAL WATER DISTRICT hereby order the detachment of all of the land described in Exhibit "B", consisting of one page, attached hereto and made a part of this resolution,from the CARLSBAD MUNICIPAL WATER DIS- TRICT.
