RESOLUTION NO. 1283

A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD
3 MUNICIPAL WATER DISTRICT (CMWD), APPROVING PLANS
AND SPECIFICATIONS AND AUTHORIZING THE DISTRICT
4 SECRETARY TO ADVERTISE FOR BIDS FOR LAKE CALAVERA
REMEDIAL IMPROVEMENTS, PROJECT NO. 38211, AND
5 APPROPRIATION OF FUNDS.
6 WHEREAS, the Board of Directors of Carlsbad Municipal Water District has determined
7 it necessary, desirable, and in the public interest to construct Lake Calavera Remedial
8 Improvements, Project No. 38211; and
9 WHEREAS, the plans and specifications for furnishing of all labor, materials, tools,
10 equipment, transportation, and other expenses necessary or incidental to said project have been
11 prepared and are on file in the Engineering Department of the City of Carlsbad and are
12 incorporated by reference herein; and
13 WHEREAS, the estimated project costs for the Lake Calavera Remedial Improvements
14 Project is $6,100,000; and
15 WHEREAS, the appropriation totaling $3,217,600 for the Lake Calavera Remedial
16 Improvements Project is insufficient to complete the project;
17 WHERAS, additional funds in the amount of $2,882,400 are anticipated to be needed to
18 complete the project and will be requested at time of award of construction contract; and
19 WHEREAS, a Mitigated Negative Declaration has been adopted by the Planning
20 Commission by Resolution No. 5890, dated January 18, 2006, as required by the California
21 Environmental Quality Act; and
22 WHEREAS, the Planning Commission approved a Conditional Use Permit (CUP 04-11)
23 on January 18, 2006 by Planning Commission Resolution No. 5891; and
24 WHEREAS, the Planning Commission approved a Habitat Management Plan Permit
25 (HMPP 05-03) on January 18, 2006 by Planning Commission Resolution No. 5892; and
26 WHEREAS, an appellant filed a timely appeal of HMPP 05-03 on January 23, 2006 and
27 later amended the appeal on January 27, 2006; and

1 WHEREAS, upon hearing the appeal, the City Council upheld the findings and conditions
2 of Planning Commission Resolution No. 5892 by City Council Resolution No. 2006-101 on
3 April 18, 2006; and
4 WHEREAS, the project has received the necessary environmental permits from the
5 California Regional Water Quality Control Board and the Department of the Army and an
6 agreement from the California Department of Fish and Game to conduct the improvements.
7 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
8 Water District as follows:
9 1. That the above recitations are true and correct.
10 2. That the plans, specifications, and contract documents, on file in the
11 City Engineer's office as described above for the Lake Calavera Remedial Improvement Project,
12 Project No. 38211, are hereby approved.
13 3. The District Secretary of the Carlsbad Municipal Water District is hereby
14 authorized and directed to publish, in accordance with State law, a Notice to Contractors Inviting
15 Bids for the construction of the Lake Calavera Remedial Improvement Project, Project No. 38211,
^ in accordance with the plans, specifications, and contact documents referred to herein.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 21st
day of, November, 2006, by the following vote:
AYES: Board Members Lewis, Hall, Kulchin, Packard, Sigafoose
