A RESOLUTION OF THE BOARD OF DIRECTORS OF
3 CARLSBAD MUNICIPAL WATER DISTRICT (CMWD),
DECLARATION OF TERMINATION OF LOCAL EMERGENCY
4 FOR REPAIR OF A RECYCLED WATER LINE BREAK ON
PALOMAR AIRPORT ROAD.

WHEREAS, on March 10, 2009 the Executive Manager of the Carlsbad Municipal Water

District declared a Local Emergency to complete urgency repair work on a 27" recycled waterline
Break crossing the three East bound lanes of Palomar Airport Road, approximately 500' East of
8
El Camino Real; and
9
WHEREAS, current law requires that a report be provided every two weeks on the status10
Of the emergency; and11
WHEREAS, this action is to retroactively cover the report period up to March 31, 2009;
and
13 WHEREAS, this action is to terminate the local declaration of emergency; and
14 WHEREAS, the cost of the repair is $95,165 and there are no additional costs anticipated
15 with this event; and
16 WHEREAS, staff is requesting an additional appropriation of $95,165 from the Recycled
17 Water fund; and
18 NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board
1 9 of the City of Carlsbad, California, as follows:
20 1. That the above recitations are true and correct.
21 2. This resolution is effective to cover the reporting period from up to March 31, 2009
22 nunc pro tune.
23 3. The declaration of emergency is hereby terminated according to State law.
24 4. That $95,165 can be appropriated from the Recycled Water fund balance to pay
25 for the repairs.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of
Directors of the Carlsbad Municipal Water District of the City of Carlsbad on the 2nd day
of June, 2009, by the following vote to wit:
AYES: Board Members Lewis, Kulchin, Hall, Packard and Blackburn.
NOES: None.
ABSENT: None.
