A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT BOARD (CMWD), ACCEPTING BIDS AND
AWARDING A CONTRACT TO BURTECH PIPELINE INCORPORATED FOR AN
AMOUNT NOT TO EXCEED $1,155,808 FOR CONSTRUCTION OF THE
RECYCLED WATER PHASE Ill PIPELINE EXPANSION SEGMENT 9, PROJECT NO.
5208-A.
EXHIBIT I
WHEREAS, the Carlsbad Municipal Water District Board of the City of Carlsbad, California has
determined it necessary, desirable, and in the public interest to install approximately 3,170 linear feet
of 8-inch diameter and 1,460 linear feet of 6-inch diameter polyvinyl chloride (PVC) pipeline for
recycled water services; and
WHEREAS, on May 23, 2017, through the adoption of Resolution No. 1572, the Carlsbad
Municipal Water District (CMWD) Board approved plans and specifications, and authorized the
secretary to the Board to advertise to receive bids for the construction of the Recycled Water Phase Ill
Pipeline Expansion Segment 9, Project No. 5208-A (Project); and
WHEREAS, an environmental impact assessment was conducted for the Phase Ill Recycled
Water Project, and a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program
was approved by the Board through Resolution No. 1455, on Nov. 27, 2012; and
WHEREAS, on May 3, 2017, through the adoption of Planning Commission Resolution No. 7241,
the Planning Commission of the City of Carlsbad approved a Coastal Development Permit to construct
the Project; and
WHEREAS, four sealed bids were received on Sept. 7, 2017, by CMWD, for the construction of
the Project; and
WHEREAS, the lowest responsible bid was submitted by Burtech Pipeline Incorporated in the
amount of $1,155,808; and

WHEREAS, funds have been appropriated from the Recycled Water Phase Ill -Pipelines, CIP No.
5208 and are sufficient for the completion of this Project; and
WHEREAS, subsection 3.28.040(C}(5) of the Carlsbad Municipal Code authorizes the executive
manager to approve change orders in the amount equal to the contingency set at the time of project
award.
NOW, THEREFORE, BE IT RESOLVED by the Carlsbad Municipal Water District Board of the City
of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the bid in the amount of $1,155,808 submitted by Burtech Pipeline Incorporated
for construction of the Recycled Water Phase Ill Pipeline Expansion Segment 9, Project No. 5208-A, is
accepted and the president of the Board is hereby authorized to execute a contract with Burtech
Pipeline Incorporated.
3. That the executive manager or designee is hereby authorized to approve construction
change orders up to $139,000.
4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid, executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 days of adoption of this Resolution. The executive
manager may grant reasonable extensions of time.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Carlsbad Municipal Water
District of the City of Carlsbad on the 24th day of October, 2017, by the following vote, to wit:
AYES: K. Blackburn, M. Schumacher, C. Schumacher, M. Packard.
NOES: None.
ABSENT: M. Hall ~ KEIT BLACKBURN, VICE PRESIDENT
