HomeMy WebLinkAbout1958-01-14; Planning Commission; Resolution 48- -1 ., 1 2 3 4 5 6 7 8 9 10 11 - I RESOLUTION NO, 48 A RESOLUTION OF THE CAELSSAD CITY PLANNING COMMISSION SETTING FORTH FINDINGS OF FA.CT AND DETERMINING THE DATE OF ABATEMENT OF CERTAIN PROPERTY IN THE CITY OF CARLSBAD. WHEREAS, the request was made by a citizen to the Commissic to the abatement of a non-conforming building, on property described ll and A portion of Section 1, Township 12 South, Range 5 vi Lot 1, more particularly described in Assessor's Bo No. 35, Page 171, Parcel 28, located on the North si o€ Laguna Drive just West of the North termination 0: Roosevelt Street in the City of Carlsbad, County of SL Diego, State of California; 12 WHEXEAS, the. Planning Cornmission has heard the opinion of tl 13 Commission under section 1706 of Ordinance No. 9060, 16 WHEREAS, certain determinations must be made by the Plannin 15 rnent provisions of Ordinance No. 9060; and 14 Planning Consultant and the City Attorney as to the applicability of the 17 hTOW, THEREFORE, the Planning Commission resolves and det l8 ll the following facts: 19 1. That the date of the establishment of the non-conforming built 20 is October 10, 1955. 21 2. That there have been no structural alterations or enlargment 22 3, That the building is a Type V building. 24 abatement of the non-conforming building than is set forth in the ordin; 23 the said building which makes it necessary to establish a later date foz 25 4. That in accordance with the provisions of Ordinance No. 9061 26 Planning Commission held on the 14th day of January, 1958, by the foll 30 PASSED, APPROVED AND ADOPTED at a regular meeting of tl 29 of the Plaraing Commission in accordance with Ordinance No. 9060. 28 5. That the s,et back r-equest conforms .with other property in th to the East, which is C-2 zone; and 2. That it will not be. detrimental to adjacent property owners. PASSED, APPROVED AND ADOPTED at a regular meeting of Garlsbad City Planning Commission held on the 20th day of January, by the following vote: AYES: Chairman Baumgartner , Commissioners Fennel, Jarvie Swirs’ky and Ebright, NOE’S: None ABSENT: Commissioners Stringer and Engelmann.
