RESOLUTION NO, 80
A RESOLUTIOH OF THE CARLSBAD CITY
ON PROPERTY LEGALLY DESCRIBED AS
ASSESSOR'S PARCEL EO. 35-170-46, TRACT 117 OF CaRLSBAD LANDS, IN THE CITY OF CkRLSBAD.
PLANWING CONBIISSION DEXYIWG A VAI'IIANCE
WHEBEAS, JAMES A. SCAhrLON did apply for a variance on th
height of a fence from 42 inches to 72 inches; and
6VB33EAS, the Carlsbad City Planning Commission did publi
a legal notice of kearing on July 10, 1958, of a hearing to b
held on July 22, 1958 at 7:30 P*E.; and
WEHEAS, the Carlsbad city Planning Comission did hold
hearing on July 22, 1958 at 7:30 P.D!*, and on August 26, 195E
at 7:30 P,M.; and
WEREAS, at said public hearing the said Planning Commis
received the recommendations, objections, protests and commen
of all individuals and parties who desired to be heard.
NOW, THEREFCRE, BE IT RESOLVED that the variance be deni
as requested, for the following reasons:
1. The ordinance cleaaly states that it is not good
planning, even though there were no protests registered
by the adjoining property owners, as it woad be
setting a precedent that would involve a great harm
or problem.
2. The nature of the fence will allow its proper
location without undue hardship to the owner.
3. If a building permit had been taken out that this
error would not have been made,
PASSED, APPROVED AND ADOPTED at a regular meeting of the
CmZsbad City Planning Commission held on the 26th day of Aug
1958, by the following vote:
