AKD NORPlA E, EXANS did apply for a variance fol 9 property line, on property located on the south side of Forest Avenue bel 10 reduction of side yard set back from 7 feet to 5 feet on the west side Highland Drive and Olive Drive in the City of Garlsbad; and li 12 WHEREAS, the Carlsbad City Planning Commission did publish a legal 13 at 7 :30 P.M. ; and 14 notice of hearing on April 30, 1959, of a hearing to be held on May 12, : 15 WHEREAS, there were no protests registered by the surrounding prope: 16 owners; 17 MOW, THEREF'ORE, a motion was duly made that the variance be granted 18 the following reasons: l9 1 2o I 22 i 25 li 25 I ! 1. Due to the contour of the ground on the east side of the lot, t variance is necessary in order to allow sufficient room for a drive way on the east side of the house. 2, Granting this variance would not reduce the side yard on the we side of the house in excess of the minim requirement of 5 feet. 3. Granting this variance will not be detrimental to property or 21 1 I 24 I i/ 25 ji improvements in the neighborhood. 4, Granting this variance will not adversely affect the comprehen- 27 sive general plan, 28 1 THEREFORE, after a roll call vote of the Commissioners, the motion 29 11 to pass for the lack of a sufficient majority; and :y 1 to wit: TIBREFORE, the request for a variance was denied by the following I 32 I I IJ c I I1 0 e 1 2 3 AYES: Commissioners Fennel, Stringer, Clisbe and Jamie.
