RESOLUTION NO. 161
A RESOLUTION OF THE CARLSBAD CITY
PLANNING COMNISSION DENYING A VARIANCE
ON FROPERTY DESCRIBED AS PORTION OF
TRACT #2, LAGUNA MESA TRACTS, ACCORDING
TO MAP THEREOF NO, 1719 IN THE CITY OF
CARLS BAD.
WHEREAS, DONALD A. BRIGGS, JR. did apply for a variance for reductio
front yard from 20 feet to 2 feet; reduction of rear yard from 20 feet to
rear yard; and the increase of the side yards from 10 feet to 15 feet on
lots lying on the west side of Jefferson Street between Las Flores Drive
Freeway, said property being a portion of Tract No. 2, Laguna Mesa Tracts
according to Map thereof No. 1719 in the City of Carlsbad, said three lot
being legally described as follows:
Parcel #l (Southerly Parcel)
Beginning at the intersection of the centerline of Carls-
bad Road with the Westerly line of Jefferson Street, 60
feet wide as said street is shown on the map of San Diego
County Road Survey No, 843; thence along said centerline
of Carlsbad Road North 52O29' West 128,15 feet; thence
North 23"44' West 65,82 feet; thence North 3O59' West
28.96 feet; thence leaving said centerline of Carlsbad
Road South 86O55'10" East 78.30 feet to a point on the
Westerly line of said Jefferson Street, said point being
the beginning of a 430-foot radius curve concave Easterly;
thence along said Vesterly line and tangent to said curve
South 17O41' East 171.06 feet to the point of beginning,

Beginning at the intersection of the centerline of Carlsbad
Road with the Westerly line of Jefferson Street, 60 feet
wide as said street is shown on the map of San Diego County
Road Survey No, 843; thence along said centerline of Carls-
bad Road North 52O2'3' West 128.15 feet; thence North 23°44t
West 65.82 feet; thence North 3"59' Vest 28-96 feet to THE
TRUE POlNT OF BEGINNING; thence continuing along said
centerline North 3"5gt West 130.96 feet; thence leaving
said centerline South 84"01'28'1 East 67.35 feet to a point
on the Westerly line of said Jefferson Street, said
Westerly line being a 430-foot radius curve concave
Easterly, a radial line to said point bears South 89"37'50'Q
West; thence Southerly along said Westerly line and the
arc of said curve 129.94 feet through a central angle of
17°18'50t8 to the beginning of said curve; thence leaving
said curve and said Westerly line North 86"55'10** West

WHEREAS, the Carlsbad City Planning Commission did publish a legal nl
of hearing on May 12, 1960, of a hearing to be held on Play 24, 1960, at 7
P.M. ; and
WHEREAS, at said public hearing the said Planning Commission receive'
recommendations, objections, protests and comments of all individuals and
who desired to be heard;
NOW, THEREFORE, a motion was duly made that the variance be granted :
the following reasons:
(1) That granting the variance would permit the best use of the land
due to the extreme topography.
(2) That similar variances have been granted on beach front property
where the topography precludes construction with normal set-backs.
(3) That granting the variance would not be detrimental to public we
or injurious to the property or improvements in the vicinity.
THEREFORE, after a roll call vote of the Commissioners, the motion f:
to pass €or the lack of a 2/3 majority vote of the Commission; and
THEREFORE, the request for a variance was denied by the following vol
