5 WBEREAS, DONALD 3RIGGS JR. did apply for a variance for reduction of

the Freeway, said property being a portion of Tract ij2, Laguna Xesa Tract: 9
lots lying on the west side of Jefferson Street between Las Flores Drive : 8
rear yard; and increase of the side yards from 10 feet to 15 feet on threc 7
front yard from 20 feet to 2 feet; reduction of rear yard from 20 feet to
10 according to map thereof No. 1719 of the City of Carlsbad, said three lot:

WEREAS, the Carlsbad City Planning Commission did publish 2 legal nc
of hearing on July 14, 1960, of a hearing to be held on July 26, 1960, at
P.M. ; and
WHEREAS, the said public hearing was held by the Carlsbad City Planni
Commission on July 14, 1960, and at said public hearing the Carlsbad City
Planning Commission received the recommendations, objections, protests &c
comments of all individuals and parties who desired to be heard;,
NO1.1, THEREFORE, BE IT RESOLVED that the variance be granted as submil
for the following reasons:
1. Tha.t granting the variance would permit the best use of the land C
the topography,
2. That similar variances have been granted on beach front property %
the topography precludes construction with normal setbacks.
3. That granting the variance would not be detrimental to public welf
or injurious to the property 0.r improvements in the vicinity.
4, This property is located on the outside radius of the curve on Jef
Street, therefore, a dwelling would- not cause any additional traffic hazar
