A RESOLUTIOW OF THE CARLSBAD CITY
PLANNING COP4KISSZON GXANTING A
VPXIANCE ON PROPERTY DESCRIBED AS
LOTS L dl M, BLOCK 1, PALISADES
HEIGHTS, IN THE CITY OF CARLSBAD,
ACCGRDING TO NAP THEREOF 80. 1777
OF THE CITY OF CARLSBAD -
WHEREAS, DR. & MRS. ROBERT E. O'BRIAN did apply for a variance for rf
of lot area per dwelling unit from 1200 sq, ft. to 974 sq. ft. in order tc
construct sixteen (16) units instead of thirteen (13) units on property
described as lots L & M9 Slock 1 of Palisades Heights in the City of C-arl!
according to Map thereof No. 1777 of the City of Carlsbad; and
WHEREAS, the Carlsbad City Flaming Comission did publish a legal nl
of hearing on July 14, 1960, of a hearing to be held on July 26, 1960, at
7:30 PAa; and
W€lEREriS, the Carlsbad CiLy Tlanning Commission did hold a hearing on
July 26, 1960, at 7:30 P.K.; and

WBEREAS, at said public hearing the said Planning Commission receive
recommendations,.objections, protests and camments of all individuals and
who desired to be heard;
NOW, THEREFORE, BZ IT RESOLVED that the request for said variance be
granted for the following reasons:
1. Granting the variance would permit the highest and best use of th
2. The requirements of Ordinance 9060 for setbacks are being conplie
with.
3. Granting the variance would not be detrimental to public welfare
injurious to the property or improvements in the vicinity.
PASSED, APPROVED AXD ADOPTZD at a regular meeting of the Carlsbad Ci
Planning Com.ission held on the 26th d2y of July, 1960, by the following
