' : ' The Carlsbad City Planning Comission of the City of Carlsbad does hereby resolve as follows: WHEREAS9 there was filed Qith this Comission on the 7th day of July,:. 1960, an application from John and Norma Ortega requesting a change of zone classification under the provisions of Ordinance Nol 9060; and LJH2K@.S, the Carlsbad City 2lanning Conmission did publish a legal,notice of hearing on July 28, 1960, of P hearing to be held on hugust 9, 1960 at 7:30 P.M.; and %MEBEIS, the Carlsbad City Planning Commi'ssion did on the 9th day of hugust, 1960, hold a duly advertised public hearing as prescribed by law to consider reclassification from Zone 8-1 (One Family Residential) to Zone 2-2 (Two Family Residential) of that property described as: Par 35~44-P Caxlsbad Lands Beg at Int of cfl of Grand Ave. and Swly Bdy of Tct 117 Th S 34* 33' E 140 ft. Th N 550 27' E 50 Ft Th N 34;9 33' \4 140 ft. The S, 55@ 27' W 50 Ft Th to Beg. Tct 117 and T/JHERUS, the Carlsbad City Planning has found the following facts to exist: lr That such reclassification is necessary for the preservation and en- joyment of e substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question. 2. That the granting of such reclassification will not be materially detrimental to the public welfare or injurious to the property or improve- m ments in such vicinity and zone in which the property is located. ,. 3, That the granting ,of such reclassification' will not aeversely effect the comprehensive general plan, .. NOW, THEREFOi:E, BE IT lIESdLVEE, that the reclassffication of the above described property from Zone R-1 tp Zone R-2 .is hereby recommended 'to be approved; IaD FINALLY RESOLVED, that a copy of this resolution to forwarded to the City Council for its attention in the manner prescribed by law* II
