RESOLUTION NO. 219
A RESOLUTION OF THE CARLSBAD CITY PLANNING
COMMISSION GRANTING A VARIANCE ON PROPERTY
DESCRIBED AS LOTS 21 AND .-22, BLOCK A, HAYES LAND COMPANY ADDITION* ACCORDING TO MAP THERE]
OF NO. 1221 OF THE CITY OF CARLSBADi BEINGPARCELI
17 AND E., PAGE 60, BOOK 35 OF THE A.SSESSOR"S MAP
OF SAN DIEGO COUNTY.
WHEREAS, Philip 5. Miller did apply for a variance for reduction in
yard SeWiack from 20 feet to 6 feet on property located on the west side
Ocean Street between Cypress and Beech Streets, being lots 21 and 22 7 E
Hayes Land. Company Addition, according to a Map thereof No. 1221 of th
of Carlsb,ad, more particularly described as Parcels 17 and 18, Page 60
35 of the..Assessor's M.ap of San Diego County; and

WHEREAS, the Carlsbad City Planning Commis-sion did publish a leg
of hearing on August LO , 1961 of a hearing to be held on August 22 t 1961 a
P .M.; and
WHEREAS, the Carlsbad City Planning Commission did hold a heari~
August 22, 1961 at 7:30 P.M.; and
WHEREAS, the Carlsbad City Planning Commission did continue the
to September 12+ 1961 at 7:30 P.M. and
WHEREAS, at said public hearing the said Planning Commission rec
recommendations, objections, protests and comments of a11 individuals
parties who desired to be heard;
NOW t THEREFORE, BE IT RESOLVED that the request for said va~
be granted for the following reasons:
1. That such variance is necessary for the preservation and enjoym
a substantial property right possessed by other property in the same vic
zone but which is denied to the property in question.
2. Thai the granting of such variance will not be materially detrime
the public welfare or injuri-ous to the property or improvements in such
