RESOLUTION NO. 228 .-
A RESOLUTION OF THE GARLSBAD GT;TY
PLANNING COMMISSION GRANTING A
VARIANCE ON PROPERTY LEGALLY
bESeRIBEb AS LOT 3, TERRAMAR UNIT L.
WHEREAS, DAVID M. AND BARBARA D, .BEGKETT, did apply for
variance to allow a reductiop in front yard setback from 20' to 10' 6'; ar:
rear yard setback from 12.5' to 6' on property located on the south side
Shore Drive, on the southerly portion of Shore Drive, West of Carlsbad
Boulevard, said property being more particularly described as Lot 3,
Terramar Unit I, in the City of Carlsbad; and
WHEREAS, The Carlsbad City Planning Commission did publish a I
notice of hearing on November 2, 1961, of a hearing to be held on Nova
1961, at 7:30 P.M.; and
WHEREAS, the Carlsbad City Planning Commission did hold a hear
November 14, 1961; and
WHEREAS, at said public hearing the said Planning Commission req
the recomm.endations, objections , protests and comments of all individl
parties who desired to be heard?
NOW i THEREFORE, BE IT RESOLVED that the request for said va
be granted for the following reasons:
1. That such variance is necessary for the preservation and enjop
substantial property right possessed by other property in the same vici~
zone but which is denied to the property in question,
2. That the granting of such variance will not be materially dekrimq
the public welfare or injurious to the property or improvements in such
and zone in which the properky is located,
3. That the granting of such variance will not adversely affect the c
hensive general plan.
PASSED, APFROVED AND ADOPTED at a regular meeting of the C,
