NO. $,o@, ARTICLE 11, SECTION 212, DEFINING THE POTNT 1 The Carlsbad City Planning Cornmission of the City of Carlsbad does 6 resolve as follows; 7 WHEREAS, the Planning Commission did on the 1 lth day of Septembt 8 Section 212 ;'and g adopt Resolution of Intention No. 35 to amend Ordinance No. 9060, Artic 10 WI-IEREAS, said Planning Commission did on the 23rd day of October 11 12 hold a duly advertised public hearing as prescribed by law to consider an ment to Ordinance No. 9060, Article 11, Section 212, defining the point o: 13 mnt for building heights as follows: 14 "Building Height means the vertical distance measured from the offic sidewalk or property line grade of the highest abutting street at the cf 15 of the building structure to the highest point of the roof. It 1.6 WHEREAS, at said public hearing the said Planning Commission recc 17 the recommendations, objections, protests and comments of all individua 18 parties who desired to be heard; 19 20 21 22 23 24 25 26 WHEREAS, said Planning Commission has found the following facts tc 1. That the present Ordinance No. 9060, Article 11, Section 212 is V; ambiguous and unintelligible. NOW, THEREFORE, BE IT RESOLVED that said amendment to Ordir No. 9060, Article II, Section 212 of the City of Carlsbad is hereby recom to be approved. AND FINALLY RESOLVED, that a copy of thiS Resolution be forward< the City Council for its attention in the manner prescribed by Law. 27 28 29 30 31 32 PASSED, APPROVED AND ADOPTED at a regular meeting of the Car City Planning Commission held on the 23rd day of October, 1962, by the 1 vote, to wit: AYES: Commissioners Davis, Ward, Ewald, Grant, Palmer, Jarvie NOES: None.
