WHEREAS, PIRATES' COVE, INCORPORATED, did apply for a vari to allow a reduction in front yard setback from 10' to 0' , and side yard s 7 lots 10 and 11, Block D, Map No. 2152, Resubdivision No. 1 and Portio 9 Drive and Adams Street, more particularly described as Portion of Bell 8 from 4' to 3' on property located at Shelter Cove Subdivision, between I 10 Rancho Agua Hedionda, Map 823, being Parcel 10 of Book 206, Page 201 11 Parcel 5 of Book 207, Page 100 of the Assessor% Map of San Diego Coc 1 WHEREAS, the Carlsbad City Planning Commission did publish a leg 13 I notice of hearing on February 14, 1963, of a hearing to be held on Febru 14 1963, at 7:30 P.M.; and l2 I I.i7 11 i WHEREAS, the Carlsbad City Planning Commission did hold a hearil 16 1 February 26, 1963; and 17 WHEREAS, at said public hearing the said Planning Commission rec 18 parties who desired to be heard; 19 the recommendations, objections, protests and comments of all ind.ividu 20, NOW, THEREFORE, BE IT RESOLVED that the request for said var, 21 as submitted be denied for the following reasons: 22 1. That it was poor planning to permit residential structures to be t 23 years y and that the following findings of fact exist: 32 floor, and side yard setback of 3 1/2', said variance to be in effect for t 31 second story of a 2 story structure by permitting a 2' overhang on the se 30 front yard setback of 5' on the ground floor and a 3' front yard setback 0: 29 due consideration did grant a variance to Pirates' Cove, Incorporated, fl 28 NOW, THEREFORE, BE IT RESOLVED that the Planning Commissic 27 3. It is the feeling of the Commission that these setbacks are applic: this property as it is located in a geographical compartment and is actua separated from surrounding lands. 3. It is in the best interestsof the City for this type of development. 4.
