RESOLUTION NO. 297
A RESOLUTION OF THE CARLSBAD CITY PLANNING
COMMISSION GRANTING A VARIANCE ON PROPERTY
LEGALLY DESCRIBED AS LOT 32, BLOCK 30, CARLSBAD
TOWNSITE, MAP 775, OF THE CITY OF CARLSBAD.
WHEREAS, MAY MARTINEZ ROSS did apply for a variance to allow
reduction of the northerly side yard setback from 5 feet to 2 feet and so
side yard setback from 10 feet to 5 feet, and request for permission to c
a house on lot with less than 40 feet frontage on the Northwest corner of
Chestnut and Xooseveit, located on Lot 32, Block 30, Carlsbad Townsitc
775 of the City of Carlsbad, San Diego County; and
WHEREAS, the Carlsbad City Planning Commission did publish a lei
notice of hearing on May 2, 1963, of a:hearing.to..b.e. held on May 14, 194
7:30 P.M.; and
WHEREAS, at said public hearing the said Planning Commission re(
the recommendations , objections, protests and comments of all individu
parties who desired to be heard;
NOW , THEREFORE, BE IT RESOLVED that the request for said vaz
be granted for the following reasons:
1. That the granting of such variance will not be materially detrime
the public welfare or injurious to the property or improvements in such
and zone in which the property is located.
2. That the granting of such variance will not adversely affect the c(
sive general plan.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Ca
City Planning Cornmission held on the 14th day of May, 1963, by the fo11
vote, to wit:
AYES: Commissioners Davis, Ward, Palmer, Jarvie and Sonneman NOES: Commissioner Ewald.
