HomeMy WebLinkAbout1963-05-28; Planning Commission; Resolution 303I ll * e 1 1 2 3 4 5 RESOLUTION NO. 303 A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION GRANTING A VARIANCE ON PROPERTY MAP 1722, IN THE CITY OF CARLSBAD, TO BE EFFECTIVE FOR THREE YEARS. DESCRIBED AS A PORTION OF LOT 42, SEASIDE LANDS. WHEREAS, Joe M. and Joe P. Apodaca did apply for a variance for 6 7 reduction in side yard setbacks from 10 feet to 5 feet on property locaked Assessor's Parcel 6, Book 203, Page 091 of the Assessor's Map of San 1 9 Portion of Lot 42, Seaside Lands , Map 1722 , in the City of Garlsbad, be' 8 east side of Roosevelt Street between Laguna Avenue and Grand Avenue, I 10 County; and 11 WHEREAS, the Carlsbad City Planning Commission gave notice of pu 12 within a radius of 300 feet of the exterior boundaries of the subject prope: 14 to the date of such hearing to the last known addresses of the owners of PI 13 hearing on said variance by mailing a written notice not less than ten day. I 15 1 WHEREAS, the Carlsbad City Planning Commission did hold a hearin! 16 May 28, 1963 at 7:30 P. M,; and 1 17 WHEREAS, at said public hearing the said Planning Commission rece 18 parties who desired to be heard; 19 the recommendations, objections, protests and comments of all individua 20 NOW t THEREFORE, BE IT RESOLVED that the request for said vari< 21 granted to be in effect for three years and that the following facts exist: 22 1. That such variance is necessary for the preservation and enjoyme] 23 zone but which is denied to the property in question. 24 substantial property right possessed by other property in the same vicinit 3. That such variance will not adversely affect the comprehensive gel 28 and zone in which the property is located. 27 the public welfare or injurious to the property or improvements in such v' 26 2.
