HomeMy WebLinkAbout1963-07-09; Planning Commission; Resolution 308It i 0 e 3. 2 3 4 51 RESOLUTION NO, 308 - A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION GRANTING A VARIANCE ON PROPERTY DESCRIBED AS PORTION OF LOT 1, CARLSBAD LANDS SUBDIVISION, TRAGTS 114 AND 120, MAP 1744 QF THE CITY OF CARLSBAD. WHEREAS, JOE M. APODACA did apply for a variance €or reduction yard setbacks from 9 feet to 5 feet and reduction in rear yard setback fro] 7 dl portion of Lot 1, Carlsbad Lands Subdivision, Tracts 114 and 120, Map 1' 8 feet to 10 feet on property located on the south side of Oak Avenue, being the City of Carlsbad; Assessor's Parcel 6 9 Book 204, Page 040 of the Ass 9 10 Map of San Diego County; and I1 WHEREAS, The Carlsbad City Planning Commission gave notice of pu 12 15 within a radius of 300 feet of the exterior boundaries of the subject proper 14 the date of such hearing to the last known addresses of the owners of prop 13 hearing on said variance by mailing a written notice not less than ten day: July 9 9 1963, at 7:30 P. M.; and 2.6 WHEREAS, the Carlsbad City Planning Commission did hold a hearin€ 17 WHEREAS, at said public hearing the said Planning Cornmission recej 16 parties who desired to be heard; 19 the recommendations, objections, protests and comments of all individua: 20 NOW , THEREFORE, BE IT RESOLVED that the request for said vari, 21 be granted for the following reasons: 22 1. That granting a reduction in side and rear yard setbacks will not b 23 I and zone in which the property is located. 27 the public welfare or injurious to the property or improvements in such v 26 2. That the granting of such variance will not be materially detrimen 25 and zone. 24 granting special privileges which are not already granted in the same vici 28 I 3.
