HomeMy WebLinkAbout1964-01-14; Planning Commission; Resolution 331I I i e RESOLUTION NO. 331 A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISS DENYING A VARIA'NCE FOR REDUCTION IN FRONTAGE TO CR A "PANHANDLE" LOT SPLIT ON GEXTAN DESIGNATED PROP IN THE CITY OF CARLSBAD, STATE OF CALIFORNIA. WHEREAS, C, ROY WORKMAN did apply for a variance to allow a reduction in front footage on one lot from 60 feet to 34 112 feet in order create a "panhandle" lot split on property Located on the Southerly side c Forest Avenue between Highland Drive and Olive Drive , being that certa portion of the West one acre of the North five acres of the East ten acre: the North twenty acres of the South thirty-five and a half acres of the SOL one quarter of the Southwest one quarter, except Road Survey 690 (Fore: Avenue) in Section 31, Township 11 South, Range 4 West: San Bernasdinl Meridian, in the City of Carlsbad, County of San Diego, State of Califorr described as follows: Beginning at the intersection of the centerlines of Highland Drive an FoJest Avenue; thence along said centerline of Forest Avenue, SoutE 89 58' West 659.89 feet to.the TRUE POINT OF BEGINNING, being also the Northwest cgrner of said West one acre; thence along the W line thereof, South 0 00' 30" East 328.64 feet to the Southwest corn; of said West one acre; thence along the South line thereof, South 89 East 132.07 feet to the Southeast cogner of said West one acre; then along the East line thereof, NoEth 0 00' 30" West 139.68 feet; thenc l%aving said East line North 89 . 59' West 76.57 feet; thence North 0 00' 30" WesJ 78.00 feet; thence North 89O 59' West 21.00 feet; thence No+ 0 00' 30" West 11 1 00 feet to a point in said centerline of Forest Avenue; thence along said centerline South 89O 58' West 34.50 feet tB the TRUE POINT OF BEGINNING. EXCEPTING there from that portion lying within Road Survey 690 (Forest Avenue); and WHEREAS, the Carlsbad City Planning Commission gave notice of p hearing on said variance by mailing a written notice not less than ten da) to the date of such hearing to the last known addresses of the owners of 1 within a radius of 300 feet of the exterior boundaries of the subject prop€ WHEREAS , the Carlsbad City Planning Commission did hold a hearir January 14, 1964, at 7:30 P.M.; and WHEREAS, at said public hearing the said Planning Commission rec, the recommendations t objections t protests and comments of all individu, parties who desired to be heard; 1 NOW, THEREFORE, BE IT RESOLVED that the Planning Comrnissic I I 1 1 2 3 4 5 6 7 8 9 18 13. 12 I! 13 I 14 i X I ,e 0. 1 deny the request for said variance for the folbwing reasons: 1. That this is not in line with the "Panhandle" lot split policy since t i ~ is another possible solution of opening up the landlocked property. 2, That the "Panhandle" lot split policy does not apply in this fact situation. PASSED, APPROVED AND ADOPTED at a regular meeting of the Car City Planning Commission held on the 14th day of January, 1964, by the following vote, to wit: ~ AYES: Commissioners Davis, Ward, Grant, Palmer, Jarvie and Lan ~ NOES: , Ngne .
