A RESOLUTION (GRANTING- A VARIANCE ON PROPERTY
AT THE SOUTHEAST CORNER OF THE INTERSECTION OF HARDIN(
STREET AND PALM AVENUE. ~- ~ ~~ ~- ~~~~ ~~~~ "
WHEREAS, pursuant to the provisions of Ordinance No. 9060, the Planning
Commission did on March 24, 1964, hold a duly noticed public
hearing to consider %he application of Mark A. and Ruth A. Ostrve
for a variance for the purpose of reduction in side yard setback from 6 feet
to 5 feet
on real property in the City of Carlsbad, County of San Diego, State of
California, commonly known as the southeast corner of the intersection of Harding Street and Palm Avenue,
and more particularly as:
Lot Six (6) in Block "B" of Resubdivision of portion of Alles Avocado
Acres, in the City of Carlsbad, County of San Diego, State of California
according to Map thereof No. 2027, filed May 17, 1927. EXCEPTING
THEREFROM the Southeasterly 22.03 feet and also excepting the North-
easterly 93.59 feet thereof, more particularly described in application
on file in the City Planning Office.
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard,
said Commission did find the following facts and reasons to exist which
make the (granting-of a variance necessary to carry out the PrOvis
and general purpose of Ordinance No. 9060:
1. That the lot meets all other zoning requirements.
2. That granting of the variance, subject to the plot plan below
referred to, will allow the same use of the land as neighboring
land enjoys.
3. That it would not be allowing a special favor.

NOW, THERETORE, BE IT RESOLVED by the Planni.ng Commission of
the City of CarlsSad that it does hereby (grarf,ma vaxiznce on said
property for the purpose of reduction in side yard setback from 6 feet to
5 feet
on the following conditions and limitations that the variance be granted on1
as to that portion of the lot shown on the attached plot plan which shows a
building extending to within 5' of the lot line. Said plot plan is by this
reference incorporated herein as per Exhibit "A'' attached hereto.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the Carlk+
City Planning Commission held on the 24th day of March, 1
by the following vote, to wit:
AYES: Commissioners Davis t Ward, Grant , Palmer, Jarvie and Lax
NOES: None.
ABSENT: Commissioner Sonneman.
