WHEREAS, pursuant to the provisions of Ordinance No, 9060, the Planning Commission did on April 14, 1964, hold a duly noticed public hearing to consider the application of Hehn Construction Company for a variance for the purpose of reduction in the required side yard setbac from 10 feet to 5 feet, on real property in the City of Carlsbad, County of San Diego, State of California, commonly known as and more particularly as: Lot 6, Block "C", Resubdivision of a portion of Alles Avocado Acres, Map 2027 in the .City of Carlsbad; he- pmrcel 1, Book 204, Page 191 of the Assessor's Map of San Diego County; WHEREAS, at said public hearing, upon hearing and considering the' testimony and arguments, if any, of all persons who desired to be heard, said Commission did Gnd the following facts and reasons to exist which make the (granting- of a variance necessary to carry out the provis and general purpose of Ordinance No. 9060: 1. That there was no public opposition voiced. 2. That there are other setbacks of equal size in the neighborhood. 3. That it would not be injurious to any neighboring property. 4. That it is not in conflict with the general comprehensive plan. 0 e NOW, THEREFORE, BE IT RESOLVED by the: Planning Commission of the City of Carlsbad that it does hereby (grarAw-a variznce on said property for the purpose of reduction in the required side yard setbacks from 10 feet to 5 feet, on the following conditions and limitations That there shall be no intrusions or protnasions on the sides of the building unless the City Attorney rules the same is legal. (Said opinion of City Atto1 follows:) "Regarding Resolution No.' 356 3 it is my opinion that the water heaters and enclosures proposed to be placed on the outside of the building are not architectrual features allowed to intrude into the yard area pursuant to Section 161 1 of the Carlsbad Zoning Ordinance .I' PASSED, APPROVED, AND ADOPTED at a regular meeting of the CarlbJa City Planning Commission held on the 28th day of April, 1 by the following vote, to wit: AYES: Commissioners Ward, Palmer and Grant.
