HomeMy WebLinkAbout1964-10-13; Planning Commission; Resolution 375I e e PLANNING COMMISSION RESOLUTION NO; 375 I A RESOLUTION GRANTING A VARIANCE ON SOUTHEASTERLY CORNER OF OCEAN STREET AND OAK AVENUE. ;PROPERTY AT 3108 OCEAN STREET, ON THE . . .-.. .~ WHEREAS, pursuant to the provisions of Ordinance No. 9060, the Planning Commission did on October 31, 1964, hold a duly noticed public hearing to consider the application of Charlotte F. Leftwich for a variance for the purpose of reduction in the required side yard setback from IOf to 5* on Oak Street, and reduction from 6. 3I to 5I on interior side ywd set- back; and reduction from 12.6' to 5f on the rear yard setback on real pro- perty in the City of Carlsbad, County of San Diego, State of California, commonly known as 3100 Ocean Street, on the Southeasterly corner of Ocean Street and Oak Avenue and more particularly as: All that portion of Tract 100 of CARLSBAD LANDS, in the City of Carlsbad, County of San Diego, State of California, according to the Map thereof No. 1661, filed in the office of the Recorder of said San Diego County, March 1, 1915, described as follows: Beginning at the most Westerly corner of said Tract 100; thence North 55" 27I East along the Northwesterly bound- ary of said Tract, a distance of 111, 0 feet; thence South 304 40* East parallel with the most Southwesterly line of said Tract, a distance of 63.5 feet; thence South 55" 2?* West, parallel with said Northwesterly boundary, 111.0 West along said most Southwesterly line, 63.5 feet to the Point of Beginning. WHEREAS, at said public hearing, upon hearing and considering i feet to said most Southwesterly line; thence North 30° 40* the testimony and arguments, if any, of all persons who desired to be heard, said Commission did find the following facts and reasons to exist which make the granting of a variance necessary to carry out the pro- visions and general purpose of Ordinance No. 9060: 1. That the property abuts against C-2 property on the East and this zoning sets the precedence for the commercial use of this neighbor- hood. 2. The State Park is across the street and this intensifies the use of the property. 3. Oak Avenue has an 80 foot right of way and will carry ultimate traffic load. I /I a 0 I 33 a4 15 4. That there was no objection. NOW, THEREFORE, BE IT RESOLVED by the Planning Com- rnission of the City of Carlsbad that it does hereby grant a variance on said property for the purpose of reduction in the required side yard set- back from IOi to $ O~I Oak Avenue, and reduction from 6.3t to 5f on interior side yard setback; and reduction from 12.6' to 5* on the rear yard setback. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Carlsbad .City Planning Commission held on the 13th day of October, 1964, by the following vote, to wit: AYES: Commissioners Grant, Sutherland, Lamb and Freistadt.
