A RESOLUTION GRANTING A VARIANCE ON PRO-
PERTY AT SOUTHEASTERLY CORNER OF €€ARDING
STREET AND GRAND AVENUE,
WHEREAS, pursuant to the provisions of Ordinance No. 9060, the P1;

Commission did on May 11, 1965, hold a duly noticed public hearing to co
the application of Carlsbad Investment Corporation for a variance for the
pose of reduction in the required rear yard setback from 15* to 5' on real

ly known as the Southeasterly corner of Harding Street and Grand Avenue,

WHEREAS, at said public hearing, upon hearing and considering the I
mony and arguments, if any, of all persons who desired to be heard, said
Commission did find the following facts and reasons to exist which make t
granting of a variance necessary to carry out the provisions and general &

I 1. That the granting of such variance will not adversely affect the cor
hensive general plan,
2. That the granting of such variance will not be materially detrimenl
the public welfare or injurious to the property crimprovements in such vi

3. That the subject property is located on a short block containing bot
mercial and residential-professional zoning with alley in the rear and con;
an exceptional circumstance.
4. That it would be a higher and better use of the land.
27 NOW, THEmFORE, BE IT RESOLVED by the Planning Commission

shall be allowed to stand in the yard facing the alley except on pickup days 31
on the following conditions and limitations that no trash or rubbish contain 30
the purpose of reduction in the required rear yard setback from 15 &et to 29
the City of Carlsbad that it does hereby grant a variance on said property
