The Carlsbad City Planning Commiss-ion of the City of Carl I 5 does hereby resolve as follows: 6 No. 9060, Article 16, Section 1612 ; and 8 July, 1965, adopt Resolution of Intention No. 53 to amend Ordi 'i' WHEREAS, the Planning Commission did on the 13th day of 9/ WHEREAS, said Planning Commission did on the 27th day of lo 1965, hold a duly advertised public hearing as prescribed by 1 consider an amendment to Ordinance No. 9060, Article 16, Secti l2 1612, amending the first paragraph thereof to read as follows: XI- i I 13 I i Ill I l5 I? I1 i l6 I "In any IIR" Zone no fence, wall or hedge over forty-two inches in height shall be permitted in any required front yard, in the required side yard or the street side of eit a corner lot or reversed corner lot. On corner lots and reversed corner lots a six foot 20 21 or fence may be located anywhere on the lot except in tho areas comprising the required front yard or the required 22 I -23 1 I yards on the side street side of such lots." WHEREAS, at said public hearing the said Planning Commiss 24 all individuals and parties who desired to be heard; 25 ' received the recommendations, objections, protests and comment 26 I WHEREAS, said Planning Commission did find the following 27(/ and reasons. to exist which make said amendment necessary to ca 28 29 out the provisions and general purpose of Ordinance No. 9060: 1. That this amendment will clarify the enforcement and 30 31 the controversy of distinguishing between hedges and trees.
