WHEREAS, pursuant to the provisi-ons of Ordinance No. 9O6( the Planning Commission did on August 23, 1966, hold a duly nc public hearing to consider the application of the CARLS'BAD UN: CHURCH for a variance for the purpose- of a reduction in side J setback from ten feet to zero on real property in the City of bad, County of San Diego, State of California, commonly known Morthwesterly corner of the intersection of Harding St.reet an( Pine Avenueg and more particularly as: Lots 1 thru 6 and Lo'ts 21 thru 32, Block 58, Map 775, ,Town of Carlsbad, in the City of Carlsbad, County of San Diego, State of Calif- ornia; WHEREAS, at sa.id public hearing, upon hearing and considc the testimony and arguments, if anys of all persons who desi to be heardg said Commission did find the following facts and ons to exist which make the granting of a variance necessary carry out the provisions and genera1 purpose of Ordinance No. 1. That there are extraordinary circumstances existing this property. 2. That "an honest mistake" was made in the plans submi to the City and it is too late to correct the error. 3.' That such variance is necessary for the enjoyment of Property rs'gh-ts posse-ssed by other property in the same vicin and zone but which is denied to the property in question. 4. That the grantiag of such variance will not be mater detrimental to the public welfare. 5. That the granting of such variance will not adverse1 affect the comprehensive. general plan. /I I rn t3) I1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 NOW, THEREFORE, BE IT RESOLV'ED by the Planning Commissio' the City of Carlsbad that it does hereby grant a varia'nce on I property for the purpose of a reduction in side yard setback ten feet to ze.ro on the fol lowing conditions and limitations that this be granted for that part of the building only as sh an the plan being within the required setback. PASSED, APPROVED, AND ADOPTED at a regular meeting of th Carlsbad City Planning Commission held on the 23rd day of Aug 1965, .by the followigg vote, to wit: AYES: Commissloners Smith, Sutherland, Palmateer, McCom NQES : None.
