WHEREAS, pursuant to the provisions of Ordinance No. 906( Planning Commission did on May 23, 1967, hold a duly noticed - hearing to consider the application of JOHN P. and MABEL M. L FREITAS for a variance for the purpose of a reduction in the yard setback from 20 feet to 11.5 feet, in order to construct patio sunshade on real property in the City of Carlsbad, Coun San Diego, State of California, commonly known as 3436 James at the Southeasterly corner of James Drive and Sandalwood Lan more parti cu.1 arly a's: Lot 16, Sandalwood Dale Unit No. 1 9 Map 5757 in the Cit) Carlsbad, County of San Diego, State of California; WHEREAS, at said public hearing, upon hearing and consic the testimony and arguments, if any, of all persons who desir be heard, said Commission did find the following facts and re to exist which make the granting of a variance necessary to ( out the provisions and.genera1 purpose .of Ordinance No. 9060: 1. The owner needs this particular location on his pror for a patio in order to properly use his property. 2. The granting of this variance will not interfere wi enjoyment of the view from their neighbors' standpoint. NOW, THE'REFORE, BE IT RESOLVED by the Planning Commissi the City of Carlsbad that it does hereby grant a variance on property for the purpose of a reduction in the front yard se from 20 feet to 11.5 feet, in order to construct a patio sun on the following conditions and limitations that the roof 1c the patio is not higher than the existing roof of the house.
