WHEREAS, pursuant to the provisions of Ordinance No. I/ 6i the Planning Commission did on November 26, 1968 , hold a- duly ' 11 , ECRE, for a change of. zone from R-A To P-74, (Planned Industri ed public hearing to consider the application of PAUL AND NAG on real property in the City of Carlsbad, County of San Diego lo' State of California, commonly known as the westerly side of I state #5 Freeway, Northerly of Palomar Airport Road, and Sout i :' i la ~ 13 1 l2 ~ of Cannon Road and more particularly described as: Portion of Lot H, Rancho Aqua Hedionda, Hap 823, State of California; more particularly described in application on file in the City Planning Office; WHEREAS, ,at said public hearing, upon hearing and cor 1 ing the testimony and arguments, if anyI of all persons who d to be heard, .said Commission did. find the following facts anc reasons to exist which make the approval of the application i change of zone necessary to carry out the provisions and gene purpose of Ordinance No. 9060: I in the City of Carlsbad, .County of San Diego, 14 15 16 3.7 1 8 . 19 I 2o I 22 'I 21 ,i /' 1. A grading plan shall be 'submitted to City Enginee. approval prior to commencing any grading work. 3. A drainage study shall be submitted to the City E for approval. The study should indicate the. drai improvements to be constructed. 4. All utility distribution facilities shall be plac underground in the rezoned area and on the remain of the property between Cannon Road and Palomar A port Road. 5. Sanitary sewer and water mains shall be installed serve the rezoned area as required by the City En 6, Access to the rezoned area shall be provided by e ing Avenida Encinas northerly. Such street exten should ultimately terminate at Cannon, Road. A pc right of way 70 feet in width shall be dedicated the City for this purpose, together with an apprc cul-de-sac at the end of any'increment of constrx 7. Full street improvements shall be required to prc roadway 50 feet in width and shall include the fc ing items : a) P.C.C. sidewalk 5 feet in width and contiguot b) Type "G" P.C.C. curb and gutter. c) Street pavement composed of minimum of 3 incl phaltic concrete on 6 inch base material on z ed subgrade. curb. d) Ornamental street lights and street trees. e) All street name signs, ,traffic safety d-evice: signs and barricades. f) All miscellaneous improvements that would pe: to land development in the City of Carlsbad. 8. Applicant shall enter into a bonded agreement wi, City of Carlsbad to guarantee the required publi( provements and shali pay all fees and make all dl necessary to such improvement, The City. shall a' the street dedication upon acceptance of the bon agreement. 9.
