-RESOLUTION NO. 589
A RESOLUTION GRANTING VARIANCES ON PROPERTY LOCATED
ON THE SOUTHERLY SIDE OF CHESFHUT AVENUE BETWEEN
WESTHAVEN DRIVE AND CAPS30 ROAD.
WITEREAS, pursuant to the pravicions .of ordinance No. 906
the Planning Commission did on December lo6 1968, hold a duly
noticed public hearing to consider the application 0, F JOEL C.
HUGHES, for variances for the purpose of reduction in require
frontage from 75.00 feet to 63.46 feet on Parcel A and from 7
feet to 20.00 feet frontage and 10,000 square foot required 1
area to 7.810 square feet on Parcel B in order to create a 'ly
handle' lot .on real property in the City of Carlsbad, County
San Diego, State of California, commonly known as Parcel 4, E
167, Page 8, of Assessor's Map of San Diego. County, being on
Southerly side of Chestnut Avenue, between Westhaven Drive ar
Cameo Road and more particlarly described as:
Portion of Lot "J", Rancho Agua Hedionda, Map 823,
in the City of Carlsbad, ,County of San Diego, State of California; more particularly described in application on file in the office of the Planning Department.
WHEREAS, at said public hearing, upon hearing and consic
the testimony and arguments, if any, of all persons who desi:
to be heard, ,said Commission did find the following facts an(
reasons to exist which make the. granting of variances necess'
to carry out the provisions and general purpose of Ordinance
9060:
1. That the granting of such variances would not be in
conflict with the General Plan.
2. This is a large parcel and it appears necessary to
a "panhand-le" access in order to develop.
3.' That the granting of such a variance would not be
detrimental to the surrounding property or property owners.

4. There are exceptional circumstances applicable to the
property such as the extreme depth of the lot.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio
the City of Carlsbad that it .does hereby grant variances on h
property. for the purpose of reduction in required frontages j
75,oo feet to 63.46 feet on Parcel, A and 75-00 feet to 20m
feet frontage and 10,000 square foot required lot area to 7.
square feet on Parcel €3 in order to create a "panhandle" lot
the following conditions and limitations:
1. That said lot split is hereby granted on condition
all requirements of Ordinance No. 9136 and the City "Panhand:
Lot Split Policies be met by applicants and that said new IC
shall be surveyed and monumented and that reports thereof st
be furnished to the City.
2. That both lots, excluding the "panhandle", .be of ec
sizes.
3. That side yard setbacks not be less than 7.5 feet
the rear yard setbacks be .not less than -.15 feet.
4. That only single ,story structures shall be permittc
5. A lot split map shall be filed in the office of th
Engineer and the parcels surveyed and monumented.
6. Street improvements shall be constructed on Chestn
Avenue or an agreement to construct improvements in the fut
