A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION GRANTING'A CONDITIONAL USE PERMIT TO RELOCATE A SIGN LOCATED AT 1089 ELM AVENUE, BETWEEN ELM AVENUE AND OAK STREET, ..
WHEREAS, pursuant to the provisions of Ordinance No. 906
the Planning Commission did on May 13, 1969 hold a duly notic
public hearing to consider the application of PETER D. AND LU
W. AGUILAR, for a Conditional Use Permit for the purpose of
allowing relocation of an existing TEXACO, INC. 6 foot by 36
fin sign on real property in the City of Carlsbad, County of
Diego, State of California, located at 1089 Elm Avenue, betwe
Elm Avenue and Oak Street, and more particularly described as
Those portions of Blocks 74 and 80, Town of Carlsbad, Map No. 535, also being a portion of Tract 1.15, Town of Carlsbad, amended Map No. 775 in the City of Carlsbad County of San Diego, State of California; also known as San Diego County Assessor's Parcel 7, Book 203, Page 36.
WHEREAS, at said public hearing, upon hearing and consid
ing the testimony and arguments, if any, of all persons who
desired to be heard, said Commission did find the following
facts and reasons to exist which make the,granting of a
Conditional Use Permit necessary to carry out the provisions
general purpose of Ordinance No. 9060:
1. The sign would be relocated because of freeway
widening.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commissiol
of the City of Carlsbad, that it does hereby. grant a Conditio
Use Permit on said property for the purpose of allowing reloc
of an existing Texaco, Inc. fin sign, subject to the followin
conditions and limitations:
1. The subject sign shall later conform with any new
sign ordinances which may be adopted;
2. The relocation of this sign shall not constitute a
new warranty period and will be governed by the
original date of construction or erection.
