A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION GRANTING A CONDITIONAL US€ PERMIT LOCATED ON PROPERTY ON THE WESTERLY SIDE OF JEFFERSON STREET, BETMEEN ARBUCKLE AND LAGUNA DRIVE. 1

WHEREAS, pursuant to the provisions of Ordinance No. 906C
the Planning Commission did on May 13, 1969, hold a duly notic
public hearing to consider the applic,ation of BERRY-BELL MORT1
INC., for a Conditional Use Permit to allow the construction a
use of a mortuary, parking facilities, and a front yard Varian
in the required front yard setback from. 20 feet to 10 feet,
located on property on the Westerly side of Jefferson Street,
between Arbuckle Place and Laguna Drive, and more particularly
described as:

A portion of Lot 47. of Seaside Lands, Map 1722, in the City of Carlsbad, County of San Diego, State of Californi being Parcels 6 and 7, Book 203, Page 11, of the Assessor Map’ of San Diego County, more particularly described in application on file in the office of the Planning Departm

WHEREAS, at said public hearing, upon hearing and conside
the testimony and arguments, if any, of all persons who desire
to be heard, said Commission did find the following facts and
reasons to exist which make the granting of a Conditional Use
Permit necessary to carry out the provisions and, general purpo
of Ordinance No. 9060:
1. This is a suitable and permitted use of the property
in this zone;
2. The proposed building will not be detrimental to the
adjacent properties;
3. The construction of the proposed mortuary could resul
in a trend of redevelopment in the downtown central
business area.
4. The granting of the front yard Variance is necessary
to allow appropriate use of the property.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission
of the City of Carlsbad, that it does hereby,grant a Condition
Use Permit on said property to allow construction and use of a

mortuary, parking facilities, and a front yard Variance in
the required front yard setback from 20 feet to 10 feet, on
said property, subject to the following conditions:
1. That development be generally in conformance with Exhibits A and B.
2. That the area in which the'variance is granted be developed as shown on Exhibit A.
3. That the areas shown in GREEN on Exhibit A be landscaped with a combination of flowers, shrubs, and trees, in conformance with City Ordinance No. 91 81.
4.. That a Landscape and Sprinkler Plan be submitted to the Planning Department for approval, prior to construction of said landscaping.
5. That architecture be generally in conformance with that shown on Exhibit 6.
6. That six-foot (6 ft.) high perimeter wall or fence be constructed with materials compatible to the proposed structure.
7. That exterior lighting be oriented in such a manner as not to shine'on adjacent properties and that the parking lot lighting be located in such a manner as not to be higher than the perimeter fence.
8. The closing and opening of driveways shall be done in conformance with City standards and ordinances.
9. That an encroachment permit be obtained from the City Engineering Department prior to landscaping of parkway areas .'
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Planning Commission held on the 13th day of May
1969, by the following vote, to wit.
AYES: Commissioners Palmateer, Little, Forman, Dewhurst Gullett, and Jose.
NOES: No.ne
ABSENT: None
