PRONTYARD FENCE HEIGHT, ON PROPERTY LOCATED ON THE WE2 3. 2 SIDE OF OCEAN STREET, BETWEEN GRAND AND ELM AVENUES WHEREAS, pursuant to the provisions of Ordinance No. 901 3 hearing to consider an application from OLIVER MORRIS for a 1 Planning Commission did on April 13, 1971 hold a duly noticec 4/ 61 5/jin City of carlsbaa fence height requirements, to permit an : in Frontyard Fence Height from 42 inches to Six(6) feet high, property located at 2901 Ocean Street, on the West Side of Oc between Grand and Elm Avenues, more particularly described a: 7 8 I 9 I1 20 1 I3. i( Lots 1 through 10 of Block B, Map No. 2 of Hayes Land Company addition to Carlsbad, County of San Diego Map 1; being Parcel 3, Book 203, Page 222 of the Assessor's Mal for San Diego County. 322 1 WHEREAS, at said public hearing, upon hearing and consic 13 14 I/to be heard, said Commission did find the following factsa a1 all the testimony and arguments, if any, of all persons who c 17 carry out the provisions and general purpose of Ordinance No. 16 reasons to exist which make the granting of a Variance neces: 15 1. The fence was built to protect the landowner from liabii that could possibly arise as a result of an accidental 1 from the rim of the cliff. Therefore, the fence would ultimately insure the public safety.
