" "_ 5 !I 6/ il WHEREAS, pursuant to the provisions of Ordinance NO, 9060 7 911 a Conditional Use Permit to allow one service station as part hearing to consider the application of HALL, GRISWOLD, NILSEF 8' 1 Planning Commission did on September 14, 1971, hold a public 1011 a freeway service faci.lity, on real property at the southeast 1111 quadrant of Interstate-5 and Las Flores Drive, more particulz 12 described as: I/ I1 I1 I.3 /I 14 i1 15 16 1'7 I I€3 I That portion of Lot 4, in Sectlon 31, Townshi.p '81 South, Range 4 West, San Bernadina Base and Meridian in the City of Carlsbad, County of San Diego, State of Caltforniag also hei'ng known as. portions of Parcel s 12, 43, 44, 50, Book 156 Page 012 of the Assessor"s Map of San Diego County; and more particularly described in application on file in the City Planning Department WHEREAS, at said public hearing, upon hearing and considc 19 20 21 22 necessary to carry out the provisions and general purpose of 23 j 24 the testimony and arguments, if any, of all persons wh.0 desi! be heard, said Commission did find the following facts and r( to exist which make the denial of a Conditional Use Permit said Ordinance No. 9060: 1, The proposed development is not in the best interest of ' health, welfare, and safety of the community at this time, 261i 2. A commercial development in the subject area would detral j from the residential setting which now surrounds the area. 13. It appears that an increase in traffic generated by such development would indanger the safety of the school children now walk to the Buena Vista School from west of the freeway, I contribute signifi,cantly to unnecessary noise and congestion 1 Las Flores, between Pi0 Pic0 and Interstate-5. 14. The staff at the present time cannot establish a need fo another service station. This is shown by a study which com total capacity of the service stations of Carlsbad against w they are actually pumping. The study shows an average capab of 87,500 per month. The average number of gallons pumped p month is 40,300 gallons during summer months and 33,300 gall per month during the fall, winter and spring months. This s indicates that the present stations are pumping 43% of their potential, and this does not indicatea need for more station 6. The Las Flores interchange along with Las Flores Drive were not constructed to accomodate the projected traffic vol normally associated wi.th freeway-oriented facilities. NOW, THEREFORE, BE IT RESOLVED by th.e Planning Comrnissio the City of Carlsbad that it does hereby deny a Conditional Permit on said property to allow one (1) service station, AND FINALLY RESOLVED, that a copy of this Resolution be warded to the City Council for its attention in th.e manner F scribed by law. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Planning Commission held on the 14th day of September, 1971, by the following vote, to-wit: AYES: Commissioners Jose, Dominguez, Hermsen, Dewhurst, Chairman Little I: .27 il 28 11 ABSENT: Commissioner Palmateer 11 NOES: None /i 29 ' 30 ATTEST 2 ..
