FREIBURGER, and DUFF for reduction in required front yard setback from twer feet to ten(l0) feet to allow parking and a reduction from twex feet to ten (10) feet in the rear yard to allow cons-truetion of medical clinic, on property located at the southeast corner of Jefferson Street and Home Avenue, more particularly described z Lots 14 and 15 of SCHELL AND SITES ADDITION TO CARLSBAD, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 2145, filed in the office of the county recorder of said San Diego County, February 20, 1929. WHEREAS, at saZd public hearing, upon hearing and considel the testimony and arguments, if any, of all persons who desirec be heard, said Commission did find the following facts and rear to exist which make the granting'of a Variance necessary to ca~ out the provisions and general purpose of Ordinance No. 9060 ar Title 21 of the Carlsbad Municipal Code: 1. The conditions applicable to the intended use are exceptio] and do not apply generally to the other properties in the same neighborhood and zone. 2. The granting of the subject variance will not be material11 detrimental to the public welfare or injurious to the property the neighborhood. 3. The granting of the subject variance will not adversely af: the Comprehensive General Plan. r1 )I 1 0 i; j! 1 jj I1 11 !I 1; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission 2/1 City of Carlsbad that it does hereby grant a Variance on said 1 3 i for the purpose of reduction in front and rear yard requirerneni 4 ii twenty (20) feet to ten(l0) feet subject to the follQwing condil 5 and limitations: 6 1. Utilities and streets in this area are adequate for the '7 development. 8 2, Ingress and egress to the parcel shall be approved by the 9 City Engineer prior to issuance of the building permit. jl 10 Director for approval. 14 landscape architect shall be submitted to the Parks & Recreatic 13 4. That a landscape and sprinkler plan prepared by a registert 12 City Engineer to protect sight distance at the inter.section. 11 3.
