I Lot 2, Tamarack Plaza Map No. 5944; Also l3 I 14 I known as Assessor's Book 204, Page 032, Parcel 37, in the City of Carlsbad, County of San l5 /I Diego, State of California, more particularly described in application and map on file in the City Planning Office. L8il WHEREAS, at said public hearing, upon hearing and consideri lg[jthe testimony and arguments, if any, of all persons who desired -20Iheard, !I said Commission did find the following facts and reasons 2L'lexist which make the granting of an applicaiton for Change of 2 22jinecessary to carry out the provisions and general purpose of Ti 23j[of the Carlsbad Municipal Code: 24111, This proposal completes the multiple freeway-oriented faci.1 25112. This proposal would be a welcomed asset to the City of Carl 2813. It is of the best interest of the citizens of Carlsbad. I. ti I/ I! !t 11 ! :i I! 27 !! NO\J, THEREFORE, BE IT RESOLVED by the Planning Commission o ii ii 28jjCity of Carlsbad that it does hereby-recommend approval to the 29lICouncil of 'the granting of an Amendment to Tjtle 21 of"the Carl 30Ilblunicipal Code, changing the zone from C-1 to C-2 on said prope Sli/accord.ing to the following conditions: I! i' #I I/ 11 i! 32 I\ xx // * .* il .1 c * 1; A. That the development of subject property shall conform to a ZI\ ordinances of the City of Carlsbad unless the Specific Plan Exh 311 "A" and/or the following conditions are more restrictive. 4;; ii 2. A complete landscape plan shall be submitted to the Plannin 51 Department and Parks 8 Recreation Girector prior to the issuanc 6 of any building permit. 7 13. Freeway service signs shall be limited to one(1) freestandi 8 I pole sign to be used by both the service station and the restau 9 facilities, and shall comply with the City of Carlsbad sign ord 10 4. A grading plan showing drainage provisions shall be approve 3.1 by the City Engineer prior to construction. 12 5. The parcel shall be monumented by a registered engineer or 13 surveyor. 3.4 6. Vehicular access to this parcel shall be limited to Tarnarac 15 Avenue. The existing driveway approach shall be utilized for ; 16 to the property. 1'7 17. A five foot pedestrian walk shall be provided on Sandra P1z 3.8 1 for emergency fire access. ~~~~ 8.
