S. Government survey, approved December 27, 1870, and more p8 // l7 I/ particularly described on file in the City Planning Office. 18 j/ WHEREAS, at said public hearing, upon hearing and consider 19 ij I! testimony and arguments, if any, of all persons who desired ti 1; .20 ti ii heard, said Commission did find the following facts and reaso 21 Ij /I exist which make the granting of an application for adoption'l 22 \\ ii a specific plan necessary to carry out the provisions and gen, 23 il 11 purpose of Title 21 of the Carlsbad Municipal Code: 24 [I !l i! p 1. The subject application is in conformance with the City o 25 jj 26 ii Carlsbad General Plan as amended. ii 2. The subject application is within the guidelines and reca 27./1 11 tions of the City of Carlsbad Housing Element. 28 11 ii 3. The subject application is in general conformance with tf- i! 29)1 Grove" Master Plan as adopted by the City of Carlsbad Ordinar i '''I NOW, THEREFORE, BE I'T RESOLVED by the Planning Commission 31i' City of Carlsbad that it does hereby recommend to the City Cc 32/ the adoption of a specific plan on said property, according t // i /i following conditions: 11 'I jl ,, I , <> /1 d e e ii ij :! !I li/ 1. That all specific plan requirements set forth in the Plar z\! i! Community Ordinance 9218 shall be met prior to the issuance c 3! permit far grading or building and shall include:. ti !! 4 11 a. Landscape plans 51 8 circulation system I b. Improvements for and location of the proposed pedestri 7-11 c. Architectural concept to be utilized for the recreatic 8' 9 3.0 11 12 13 1 facility d. The above items shall be submitted to the City of Carl staff and shall be subject to their approval 2. That the specific plan labeled Exhibit ''A'' shall be adopi presented. Any modofications or deviation to the specific pi be submitted to the Planning Department and shall be subject 14 be adopted as a part of the adopted specific plan. Any devi: 16 3. That up to five (5) feet of right-of-way for Elm Avenue bt dedicated to the public. 13. The water distribution and sewer collection system shall I: dedicated to the City together with the necessary easements fre liens and encumbrances. 14. On-site fire hydrants and fire protection appurtenances sb be constructed in accordance with Fire Department requirements. 15. The interior streets are proposed to be private. The foll special conditions shall apply: a. Provisions for maintaining the streets, satisfactory to the City Engineer and City Attorney, shall be provided to issuance of any occupancy permit. b. The design of all streets shall be approved by the Public Works Department and all street construction shall be inspected by the Public Works Department 21 I/ and a standard inspection fee paid. 24 j/ Criteria. 22 ii 23 f j iJ I c.
