RESOLUTION NO. 871
A RESOLUTIQN OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS RELATIVE
OM THE EASTERLY SIDE OF AVEMIDA ENCINAS, NORTHERLY OF TO CONDITIONAL USE PERMIT (CUP-75) FOR PROPERTY LOCATED
PALOMAR AIRPORT ROAD - APPROVED.
5 WHEREAS, the Planning Commission of the City of Carlsbad did rece

a verified application from WILLIAM DEALY requesting approval of a
Mobile Home Sales Facility on property described as: 8
Conditional Use Permit (CUP-75) for a period of three years, to permit a

12 WHEREAS, on February 13, 1973 , a duly advertised Pub1 ic Hearing

and heard all persons interested in or opposed to the Conditional Use 15
WHEREAS, the Planning Commission received all recommendations 14
was held to consider the proposed Conditional Use Permit; and,
17 WHEREAS, the Planning Commission did find the following facts and

the general purpose of Title 21 of the Carlsbad Municipal Code: I.9
reasons to be present which in their opinion are necessary to carry out

1. The proposed use is compatible with the existing and potential uses within the general area of the subject property.

2. The granting of this Conditional Use Permit will not adversely affect the General Plan.
3. The proposed project will not be detrimental to the public health, safety and general welfare; and,

the "City of Carl sbad Environmental Protection Ordinance of 1972'' and has 26
WHEREAS, said application has complied with the requirements of
Use Permit (CUP-751, subject to the following conditions: 30

1. The Mobile Home Sales Facility shall be removed fron the property on or before the date three years after
official P1 anning Commission approval.
2. Office facilities shall not be housed in a mobile home.
3. The subject property shall be adequately lighted, ar said lighting shall not shine on adjacent property.
