A RESOLUTION OF THE PLANNING COMMISSION OF THE FINDINGS AND RECOMMENDATIONS RELATIVE TO A ON THE WESTERLY SIDE OF OCEAN STREET, BETWEEN GRAND AND ELM AVENUES. CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS SUBDIVISION MAP (CT 73-3) ON PROPERTY LOCATED WHEREAS, the Planning Commission of the City of Carlsbad did receiv 6 acres of land, described as follows: 8 Map to provide for development of a 21 unit condominium project on 0.72 7 a verified application from R. D. MILLE@ requesting approval of a Tentati 9 10 Lots 2 through 10 inclusive, Block "Bll, Hays Land Company Addition Map No. 1221 , in the office of the County Recorder, County of San Diego. 11 WHEREAS, said application has complied with the requirements of thc 12 Tentative Map as submitted, and the reports of the various reviewing agen l5 WHEREAS, the Planning Commission did take into consideration the 14 declared to have a "non-significant" impact on the environment; and 13 "City of Carlsbad Environmental Protection Ordinance of 1972" and has bee and, I€i 17 WHEREAS, the Planning Commission did find that the subject Tentativ 18 regulations, and the State of California Subdivision Map Act; l9 Map does substantially comply with the City of Carlsbad subdivision 20 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the 21 23 of the City of Carlsbad, of the herein described Tentative Map, CT 73-3, 22 City of Carlsbad, that it does hereby recommend approval to the City Coun subject to the execution and/or fulfillment of the following conditions: 24 1. An offer of dedication shall be made to the City of 25 Carlsbad for additional right-of-way along Ocean Street. 26 I 27 I 28 29 2. A future agreement shall be entered into with the City for half-street, full frontage improvements along Ocean Stref (including curb, gutter, sidewalks, paving, street lighting, drainage and new sanitary sewer). 3. Sewer service shall be by connection to the Carlsbad Pub1 ic Sewer Sys tem. 5. Sewer and water lines shall not be laid in the same trenc 6. Proper drainage shall be maintained throughout the sub- 2 3 4 division so as to prevent ponding and/or storage of surface \ 5 6 7 7. All fire protection appurtenances shall be constructed ir accordance with City Fire Department requirements in lieu of required access roads, and said appurtenances shall be instal and functioning prior to framing construction. 1 8 I/ 8. Final map approval shall be subject to payment of Parks- in-Lieu Fees. 9 10 11 12 13 14 9. The applicant shall enter into a mutually acceptable agrc with the Carlsbad Unified School District to provide for futl school requirements that will result from the construction of residences. 10. All utilities, including electrical, telephone and tele\ shall be installed underground and/or shall be completely cor from view. I PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad I.5 j/ City Planning Commission held on the 27th day of February, 1973, by the 16 /I following vote, to wit; 17 AYES: Commissioners Dewhurst, Jose, Forman, Palmateer, Little, & N 18 NOES: None. 19 20 21 22 23 ABSENT: Commissioner E.
