FINDINGS RELATIVE TO CONDITIONAL USE PERMIT (CUP-77) WHEREAS, the Planning Commission of the City of Carlsbad did rect 5 station on property described as follows: 7 of a Conditional Use Permit (CUP-77) to allow construction of a sewer pt 6 1 a verified application from LEUCADIA COUNTY WATER DISTRICT requesting ai 8 9 10 3.1 12 I That portion of Lot 9 in Section 35, Township 12 South, Range 4 West, San Bernardino Base and Meridian, in the County of San Diego, State of California, according to Uni States Government Survey, approved Qctober 25, 1875. WHEREAS, on March 13, 1973 a duly advertised Public Hearing was held to consider the proposed Conditional Use Permit; and l3 1 WHEREAS, the Planning Commission received all recommendations and 14 general purpose of Title 21 of the Carlsbad Municipal Code: I* reasons to be present which in their opinion are necessary to carry out I'7 WHEREAS, The Planning Commission did find the following facts and 16 and; l5 heard all persons interested in or opposed to the Conditional Use Permit 19 20 21 1. The proposed development will not be detrimental to the surrounding properties. 2. All requirements set by City Ordinances have been satisfied 22 WHEREAS, said application has complied with the requirements of 23 the "City of Carl sbad Environmental Protection Ordinance of 1972"and has 24 been declared to have a non-significant impact on the environment; 25 Use Permit (CUP-77) , subject to the following conditions: 27 City of CArl sbad that it does hereby grant the herein described Condi tior 26 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the 28 29 30 31 32 1. C.U.P. be established for a period of twenty(20) year with review by the Planning Commission twenty (20) years from date of approval. 6.
