(c PLANNING COM~,IISSION RESOLUTIO~. 883 *. 1 2 3 4 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION OF A RECREATIONAL VEHICLE PARK WITH ATTENDANT RECREATIONAL FACILITIES, ON PROPERTY LOCATED ON THE SOUTH SIDE OF PALOMAR AIRPORT ROAD BETWEEN MACARIO ROAD AND KELLY DRIVE, KNOWN AS C.U.P. #58-A. 51 I WHEREAS, pursuant to the provisions of Ordinance 9060, the 6 Planning Commission of the City of Carlsbad, California, did on March 27 v 1973 hold a duly noticed public hearing to consider the application of 8 9 CHARLES AND JOYCE PRITCHARD, for a Conditional Use Permit for the purpos of constructing a recreational vehicle park with attendant recreational 10 facilities, on property generally located on the south side of Palomar A 11 Road and between Macario Road (future) and Kelly Drive (extended) , and ml 12 particularly described as : I.zi I I.f5 I I.4 I 15 I 17 18 19 20 Fifteen acres (bounded on the north by Palomar Airport Road, on the west by the southerly extension of Macario Road, on the south by the realigned watercourse, and on the east by the electric and water easement) of that parcel of land designated as "Description No. 1 , 103.91 acres as shown and delineated on Record of Survey Map #5715 filed in the office of the County Recorder of San Diego County, December 19, 1960, being a portion of Lot "G" of the Rancho Agua Hedionda in the County of San Diego, State of California, according to the map thereof No. 823, filed in the office of the County Recorder of San Diego County, November 16, 1896, and more particularly described in application on file in the City Planning Department. 21 WHEREAS, the subject application has complied with the requirement 22 to carry out the provisions and general purpose of Ordinance No. 9060. 27 reasons to exist which make the granting of a Conditional Use Permit nece 26 testimony and arguments, the Commission did find the following facts and 25 WHEREAS, at said public hearing, upon hearing and considering all 24 has been declaeed "non-significant"; and, 23 of the "City of Carlsbad Environmental Protection Ordinance of 1972" and 28 29 30 31 REASONS FOR APPROVAL: 1. The location of the proposed development does not adversely af- present land uses of the surrounding properties. 2. The proposal is in keeping with the proposed Parks and Open Spi Plan and is within densities assigned by the General Plan. 32 NOM, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad, that it does hereby grant a Conditional Use Permit , . .%I .. 1 e e -. on said property for the purpose of allowing construction of a recreation 2 described, subject to the following conditions: 3 vehicle park with attendant recreational facilities at the location previ 1. An all-weather graded emergency or secondary access be prqwided 10 i 11 I I 12 l3 I 5. That a 6-foot perimeter fence be constructed and landscaped in accordance with Ordinance 9274. 6. That the Conditional Use Permit be subject to review by the Planning Commission in 15 years, and if upon review the Planning Commission should continue the use permit, the development will be reviewed at successive 5 year intervals. 14 7. A parcel map delineating boundaries of the recreational vehicle 15 park shall be filed in accordance with the State Map Act. 16 8. A grading plan shall be submitted for approval prior to starting construction. 17 18 i 19 20 21 ~ I I 9. All utilities shall be placed underground within the boundaries 1 this park. 10. Developer shall enter into a future street agreement guaranteeinl dedication of right-of-way and improvements to City standards of (a) the remainder of Palomar Airport Road bordering the parcel to be sub divided (maximum width 26 feet); (b) that portion of Kelly Drive bordering the easterly boundary of the subdivided parcel (maximum width 84 feet) which falls within the basic parcel. 22 23 24 25 26 27 28 29 30 11. Dedicate and improve to City standard one-half of Macario Road between Palomar Airport Road and the southerly entrance to the recreational vehicle park. 12. Dedicate access rights from the basic parcel to Palomar Airport Road to the City of Carlsbad except at Public street intersections. 13. Public Sewer shall be extended for the full length of Kelly Dril and shall be connected to the Buena Trunk Line. 14. A major drainage channel passes through the property. The chan, shall be improved as required by the City Engineer to carry the flow! predicted in the City Master Drain age Study. Improvements may not be required immediately. The timing shall be subject to the approva' of the City Engineer and may be the subject of a future street agree- ment if mutually agreeable. 31 1: xx 32 ll xx -. * I' * 1.
